Hello all,
I know this might be odd but I am seeking advise. I have Tier-1 General since August 2010 - extended from UK in July 2012 and will expire August 2015..The problem is that I am still out of UK and never worked there! However I would like to maintain my visa..If I go back to UK in April 2015 and applied for extension (with my earning in teh country where I am) will they accept extending another 3 years? knowing that they accepted it before in 2012

if not, what is the alternative? any company can sponsor Tier-2 visa? I need your help to find me a solution to go back and continue live and work in UK - please note that I cannot afford Tier-1 entrepreneur solution

Hi,

Looking at this post, i am bit nervous. Please can somebody help me with this, to understand whether I should go for a 2nd extension or apply for ILR.
Visa type : Tier 1- General (valid till 1st Dec 2012)
first granted date : 1st Dec 2009
First Entry to UK : 11th June 2010 (stayed for 18 days in UK and left on 29th June 2010)
Second entry to UK : 31 Oct 2010
Holiday left UK : 30th Nov 2011 and returned on 31Dec 2011
Holiday Left UK : 29 March 2013 and returned on 20th April 2013
First extension : 1st Dec 2012 and valid till 1st Dec 2014.

I am supposed to go for 2nd extension or ILR by 1st Dec 2014. But can you clarify looking at the above details,
1. can i apply for ILR on this Dec ? if not
2. Can I apply for 2nd extension
3, If I apply for second extension, when would I be able to apply for ILR ?

Appreciate any help on this.

@Ron

Better apply for 2nd extension in Dec 14, and then you will get visa for 3 years i.e.till Dec 17. It seems you have been consistently been living in UK after 31 Oct 2010 and it would be good if you take this date as a start date towards completing 5 years. In this case you will be eligible in Oct 15 for ILR.

I just wanted to say that the people who have got tier1 either accepted or rejected should start searching for other options. Because as you can see the ukba is introducing new policies and tougher procedures that will make everyone`s stay very difficult. So I would like to suggest you guys that start looking for either green card scheme Denmark or FSW Canada 2014 (closing 31st dec 2014 ). Fsw is a Permanent Residency visa which allows you to work fulltime and after three years you can apply for citizenship. So atleast your future is secure.

Hi all,

Can someone please guide me on my case, it is similiar to some members who already posted here, slightly different in some aspect. But any guidance will be highly apprecaite.
Visa stamp: 21-07-2010
UK arrival: 22-01-2011 (after 6 months of visa)
1st extension: June 2012
1st extension validity: 31-10-2015 (got 100 extra days during extension)

I should be able to apply for ILR around 24-12-2015 (28 days before 5 year anniversary of arrival in UK), which is around 55 days after my 1st extension expires.

So my question:
1) Will the 90 days cushion (time between entry stamp and landing) be applied to me?
2) In some forums people have mentioned that with the exact same case (1-2 months short of 5 years) they were granted visa, is there an official explanation for this?
3) Do I need a second extension? If yes that would be before April 2015, will the same apply to my dependants?

Hi,

I am on Tier 1 General visa and valid up to october 2015, now due to closing of visa in April 2015 i am switching from Tier1 General visa to Tier 2 general, if i change my visa status, do i need to change all my dependents visa? or they will continue in the same dependents tier 1 visa up to october 2015? please advice.

Balaji, why are you switching to Tier 2? Why not extend Tier 1, unless the proof of income is an issue.

Hi I want to discuss my case. I got Tier 1 general on 17 Aug 2010. Came to uk on 20 Aug 2010 for a week and return back to Dubai (my then home). Came again on 27 July 2011 and settled since then. Just have three visits outside UK since then total 50 days. I got my first extension on 17 Aug 2012 for three years. Now looking to apply for 2nd extension. I have couple of questions.

1. When I shall be eligible for ILR (I assume after 27 July 2016) Will that 180 days absence rule will hurt me some how as I came initially on 20 Aug 10 but returned and came again after 11 months on 27 July 2011.

2. Can my dependants apply later than April 2015? They have visa till Aug 2015.

Looking forward to hear detailed reply.

1. Period of extensions are granted under 245CB(a). So, you should be granted an extension beyond 27 July 2016.

You may apply for ILR no sooner than 28 days prior to 27 July 2016 under 245CD.

maximum 180 days (continuous or total from multiple trips) in each 12-moth period counting back form application date

that makes a total of 900 days for tier 1 ILR but mind you have to somehow justify these absences as in line with purpose of tier 1 or on compassionate grounds

450 days is for citizenship

enter the UK before 5th of April, and apply for extension here

you can use your foreign income for this extension, if it is enough in terms of amount without uplift coefficient. it should not be a problem.

many people do it, PM me if you have questions.

but mind you still may not be able to achievee ILR in 2018 as there would be too much absences, if current rules are unchanged

however there will be new government after may 2015 most likely, no one knows what else they may come up with between that and 2018

if you are applying in summer 2016, no one will care what travel pattern or absences you had before summer 2011, only 5 years ILR qualifying period will matter

you would be able to apply starting approximately January 2016 though, basically at whatever time there will be less than 180 days left until the date of your return in July 2011 (and accounting for any other absences between then and January 2012)

you MAY be able to pull it off without the second extension at all, depending on what reasons were for your initial absence -- but it is often better not to risk if you can afford the second extension application fee, especially we dont know what the new govt may change after coming into office

Hi,
Following is my case.

Applied for Tier1 General from India in March 2011 and got visa for 2 years
Came to UK in October 2011
Applied for first visa extension in March 2013 and got visa extension for 3 years (upto March 2016)
Now, due to the deadline constraint, I am applying for my second extension in March 2015 itself (Would have applied in march 2016 if not for the deadline)

Following is my question.
1. How long will I be given the second extension for ? According to the following link :

it says this ...

Can someone please clarify my doubt ASAP , as I need to take appropriate actions in deciding to continue with Tier-1 extension for second time or shift to Tier-2 please.

Thanks for your reply, Actually I was able to obtain a job in UK and will be there by January and will apply for extension by Jan as well (my visa will expire by August 2015)

However, I was going through the guidance documents and I have read the following which I think was added new and is interesting, do you think they can give 5 years for those who had long time of absence ?

3) Tier 1 (General) extensions will be granted for either three years or the balance the applicant needs to take their time granted in the category to five years, whichever is longer. Applicants who wish to apply for indefinite leave to remain in the future must still ensure that they do not have excessive absences from the UK throughout the 5 years and can meet the specific Tier 1 (General) ILR requirements.
4) The Home Office will assess what provisions are needed for indefinite leave to remain applications once all extension applications have been processed after April 2015, and will consider making adjustments in a future change to the Immigration Rules. Under the current Rules however, applications for indefinite leave to remain will no longer be accepted in the Tier 1 (General) category from 6 April 2018. Applicants who are currently in the UK and who wish to apply for indefinite leave to remain must submit an application on or before 5 April 2018.

So are you applying extension together with your husband before April 2015 or just your husband before April 2015 and yours after april 2015

I am in same boat
My Visa expires on Feb 2016, but because of new rule, I am planning to apply early extension for my self in Feb 2016 through in person appointment
and I will apply for Visa extension for my wife (already in UK)and my new born son (already in UK) after April 2015 and that also through post, so that I can save £400 X2=£800

But I am want to make doubly sure that dependants extensions are allowed after April 2015

Please let me know your thoughts

I am also keen to know if anyone has got more than 3 years on Tier 1 extension based on the point no. 3. This point is not conclusive as even if one gets more than 3 yrs period to complete 5 years for ILR, it is uncertain if one will be eligible for ILR if that period extends beyond 6-Apr-18. Point no. 4 suggests that there might some changes in the rules but we will have wait to know those.
Still has anyone got more than 3 years period?
