Hi everyone,

For those who applied 28 (or less) days before their entry date to UK. How do you fill the paragraph D1 of the SET(O) form? Do you confirm that you have spent a continuous period of 5 years lawfully in UK or not?

If we are to apply before the entry clearance date and before entry date, we will definitely be short of those 5 years.

Our dates:

entry clearance visa: 31 Jul 2007
entry to UK: 3 Aug 2007 (stamp in passport)
stamp on entry clearance visa: 29 Aug 2007

Many thanks!

28 Days Rule

Post by GPRR1234 » Sun Jun 24, 2012 10:25 am

Hi All,
Just a quick query.
I am looking to apply for my ILR in a couple of months time.
My visa expires on 28th September (Friday). As per the 28 days rule, what is the earliest date I could apply in person at PEO? Can I book an appointment for 31 August (Friday) or will it have to be 3rd Sept (Monday).
Many Thanks

Thanks Push.
Original Visa - In country HSMP granted 28/9/07 to 28/9/09, extended till 28/09/12 under Tier 1 (general).
Hence I complete my 5 years on 28/09/12.
To count the 28 days, do I need to include or exclude 28/09. If I exclude 28/9 (Fri) then I can apply on 31/08 (Fri), else 01/09 (Sat), hence 03/09 (Mon).
I tried to get clarification about this on the UKBA site, but could not find any.

Your views please.

You can apply no more than 28 days before completing the qualifying period. In your case, the earliest you can apply is 31/08.

Hi there,

Please clarify.

I got my hsmp on 11th sept 2007. Tier 1 Visa Expiring on 10th sept 2012.

Is my assumption correct that the earliest I can apply for ILR is 13th August 2012? I need to book my PEO appt online this week and wanted to check

Thanks for your time with this

Regards

Was the HSMP approval granted on 11th Sep 2007 or you got EC/Leave to Remain on the basis of HSMP approval on the date?
