Did she have lawful leave when she left and when she returned.

If she did, then she may be able to split her period to overlook the lengthily absence

Post by tiktiki » Mon Mar 14, 2016 9:30 pm

Hello everyone

I came to uk 3rd October 2004 on dependent visa. Since then I am continue sly in uk other than may 2006to February 2007 I went to India for maternity.

I was on my own work permit from 2012 to 2014.Then again I went on dependent. My husband has got ILR now.

My question is do I have to wait till 2017 for ILR on 10 years basis or I can apply now.

Other than that long abscence I m
In U.K. With only 4 weeks holiday every year.

Can I please request you to guide me accordingly as I m due to renew my dependent visa in May. Should I apply for another dependent or Ilr

Thank you in anticipation

Rgds

On what basis did your husband get ILR (5 years PBS migrant or 10 years long residence)?

When and where did you apply for the dependent visa and is it PBS Dependent?

You will only qualify for ILR in 2018, you need 5 years residence as ILR dependent (actually called a spouse visa).

Of if you meet ALL the requirements in 2017 for ILR based on 10 years long residence, you can apply using that route.

Why do you think you can maybe apply for ILR now?

Thank you for your reply. I thought I M in uk since 2014 only with a gap of 10 months. So I thought I qualify for ILR now.

A single gap of 10 months usually breaks the Long residence requirements.

Hello

It looks like will have to apply for Dependent ILR again as 10 months gap is long.

I have gone through the form and it says dependent will have to pay £100 for the NHS. Will this rule be for dependents from the date after 6th April or will be for everyone?

Thank you in advance

You can only apply for a 2.5 year extension, there isn't a lesser time limit you can apply for on a spouse visa.

Immigration health surcharge is £500 for the 2.5 year extension and it is payable for your extension application only.

IHS applies to ALL applications made since 6th April 2015 (excluding Aus & NZ) and from 6th April 2016 Aus and NZ citizens are included and have to pay.

IHS is NOT payable for ILR applications (when you reach 10 years in 2017).

It will apply to you when you submit your application to extend your visa. It will be £200 for each year that your visa is extended.
