Great! I can re-apply with the xerox, here is the response from British High Commission:

Dear Mr hsmp28122006,

The reasons for refusal will be clearly mentioned on the refusal letter.
You have either appeal or reappy, you cannot do both.
Your application which in the interests of natural justice would be dealt with by another Visa Officer. I cannot of course guarantee the outcome of any future application. In the event the application is not successful the fee is non-refundable.

This does not clearly state that for which criteria I missed 20 points.

My claim for HSMP was:

Age - 20 points
Earnings - 25 points
Degree - 30 points

May I request you to let me know evidence for which of above (Age or Earnings or Degree) was not satisfiable?
Also, can I appeal and re-apply for Entry clearance simultaneously?

I have a small query. When I submitted the visa last time (on 5th Feb), VFS guy told me that you may be called for interview this time, since you were rejected last time.

Is this true, guys? Are future decisions biased once your visa has been refused? Any idea? Thanks!

Update on VFS website: The passport has been couriered to the applicant. Case closed.

I should be able to get the passport by tomorrow evening. Will update you guys on this.

Hi,
The British Deputy high commission in Chennai DOES NOT return the original HSMP approval letter when they deny a visa. U can reapply along with the copy of the approval and ur rejection letter. But pay attention to the grounds of refusal and substantiate it with the requisite documents.
Immigration law is mystery and a mastery in obfuscation, and the lawyers who can figure that out are worth their weight in gold.

Hi,

My EC got refused on the 26th of March 2007.

The reasons provided by the BHC...

The Entry Clearance Officer's decision
"I have refused your visa application on this occasion because I am not satisfied, on the balance of probabilities, that you meet all of the requirements of the paragraph 135a and 320(15) of the Immigration Rules. This decision will not prejudice any future visa application that you make."


The Entry Clearance Officer's reasons and supported evidence :

I have carefully considered your application. However, you do not qualify for a visa for the following reasons.

You have applied for Entry Clearance to work in the UK under the HSMP. To qualify in this category you are required to score 75 points under the new points criteria, which took effect from 5th december 2006. From the documents you have submitted with your application i am not satisfied that you have scored enough points. My estimation of your points is as follows :

master degree = 35
salary earnings = 25
age = 10

Total = 70

In addition i note that you have a spouse and child who do not intend travlling to uk with you and therefore not satisfied that you intend to make the uk your main home because i am not satisfied that you have scored sufficient points i am not satisfied that false representations were not made and that all materials facts were disclosed for the purpose of obtaining your immigration employment document.


I have gone thru the information from this thread and found that lot of information was there that suits my case.

case background:
The EC officer calculated the income earned from previous earnings as the IT returns of previous year (IT returns of year 2005 - 2006 ; Assessment year 2006 - 2007) . He/she misinterpreted the earnings calcuation and given me 25 poitns for earnings. But i am already eligible for the earnigns of 40 points. (Then how will i get the HSMP approval letter if the points as mentioned in the REFUSAL FORM is 70).

Not sure why the EC officer refused my application.

You should talk to VFS people here. They will give you exact information , not thoughts or probables. common sense says if the approval letter was withheld, they know of it and mentioning it will explain to them why you are not reattaching ti... but like i said. talk to someone in the vfs u applied thru
