Unfortunately the HO have no obligation to decide your application by any particular time and it is normal not to decide applications if a trial is pending.

If you need to travel your solicitor can apply for the bail conditions to be varied allowing you to leave the UK temporarily before the trial and if the application is granted the solicitor can then apply to the HO for your passport to be returned.

Did the op say there is a bail condition preventing travel?

No, the OP didn't mention bail but the "innocent until proven guilty" principle will not wash with the HO. They are holding the OP's passport and will not return it unless some convincing representations are made to them. The matter may be further complicated if the OP's original leave expired and his current leave is only under section 3C.

OP is entitled to a resolution one war or the other, is he not?

He cannot be kept in a limbo for an indefinite period, surely
