Today we’ve revived a letter from the government legal department stating the SSHD’s defence requesting the tribunal not to give us in country appeal right as he thinks we don’t have any private & family life in uk.

Hello,
I am posting in new topic because I could not post on my old indefinite leave to remain topic.
My husband’s ILR was refused on 353 ground. He asked HO to review through PAP and judicial review but both refused. He is now going to go for an oral hearing.
I am going to be eligible for my ILR in 14th February 2018. When my husband applied ILR I varied my application to FLR(M). Now what is my chance?
Any help and suggestion would be really appreciated.

Came to the uk 14th February 2008
Since then up until June 2017 I was my husband’s dependant. My husband’s set(o) (private life) was refused as clearly unfounded without appeal right. He then applied FLRFP within 14 days of his refusal. By that time he finished his 10years and varied visa to set LR. He was refused on the ground that as his FLRP visa has not determined as a successful that means you are not eligible for ilr.
In October 2017 I varied my visa to FLRM.

Another sad day for us as we were not given permission for JR in an oral hearing for unfounded certification(set(o) family) and subsequent ILR refusal. Any suggestion what to do next please.

Hi
My set LR was refused in March 2018 with an appeal right. I appealed and subsequently got DLR. HO considered me as an overstayer of 9months because my husband’s ILR was refused in October 2017. As I was his dependant they count me as an overstayer also. My question is as I have given leave to remain on my LR appeal and regularise my visa can I make a fresh application for my ILR again.

I have split and moved your post to your previous topic so that members can understand your complicated story.
You don't qualify for ILR based on long residence as you do not have 10 years legal stay.

But I have regularised my visa with my set LR which means my previous overstaying period should be ignored.
