Re: 6 months bank state for ILR

Post by Luckyagbomu » Fri May 01, 2020 2:05 am

Morning everyone.
Finally got paid and I’m flabbergasted as I only received £1,094.54 before tax thanks to Covid19.

This means I need to show my 12 months earnings to the meet the £18600 right?

On the home office site( even though I have changed it to “Not the same amount continuously and above the financial requirements amount”
It shows I need to provides 6 months worth of payslips

Please advice. Stress is understatement.

Please help 🙏

ILR for spouse using SET(M)

Post by Luckyagbomu » Mon May 11, 2020 3:40 am

Couldn’t get any help or respond from my post.
Sorry 😐

Hi, hoping I can get some advice from you guys. Basically my wife is due to apply for the U.K. indefinite Leave to remain.
However, my earnings have gone down drastically as I only get 80% of my wages. Due to the way the home office calculates using the lowest wages of the 6 months I will definitely not meet the financial requirements but in the last 12 months I have warned £22k plus.
The questions
1. So do we combine a 6 months payslips or 12months?
2. Should I use only my payslips for 12 months?

In the online form. It doesn’t state under what CAT.

Kind regards

Lucky

Apply under category B as you have already earned at least £18600 during the last 12 months. If your employer letter state your base salary which as per you was actually £24K at the time of application then despite you were paid less during the last month will indeed meet the requirement. Otherwise if your partner's base salary is at least £18600 on the date of application then still that part of category B can be met.

Thank you Seagul.

Regarding the finance section of the online form, there is a box to tick and I am not sure what the right one is for me.

3 questions please
(1) The same amount continuously, above the financial requirement amount (I don’t get paid the same monthly but definitely over the £18,600 a year.)

Or

(2) Not the same amount continuously, above the financial requirement amount (I’m leaning towards this one! I’m I correct?

(3) Finally, 6 months payslips or 12 months?(the online application still asking for 6 months :!:

Option 2 is appropriate. Supply 12 months of payslips with bank statements. Ideally add a covering letter showing the calculations as how you are meeting the requirement.

Hi Seagul,

thank you very much for all the information and assistance you have provided for me.

I think I have done everything now and I'm composing a letter as you advised.

should I include this in the letter:?? to let caseworker know that I am applying under cat B.

im also planning to workout the 12months earning in a spreadsheet>what's your take on this one?

5.3.10. So, under Category B, the assessment of the financial requirement is based on both:
(1) The gross annual salary or income from salaried or non-salaried employment at the date of application.
(2) The actual amount of gross income received from any salaried or non-salaried employment in the 12 months prior to the application.

Please remember I'm applying under cat B due to being furloughed. I received a letter from my employer stating my contract:
1.Contract-permanent fulltime,
2.Hourly Ratte:£24,611.12 PA
3. start date
4. Role

sorry for the essay :D :D

looking forward to your reply

many thanks

Lucky.

You don't need to quote the category B theory in your covering letter because caseworker must know it. You simply demonstrate your calculations as how are you meeting the financial requirement and what are you supplying them on same covering letter instead using any spreadsheet.

Hi all,

its me again and just one quick question please!

we were going through the Wife ILR online application for Final check before submitting it. then we came across this madness.

For either the UK or any other country, have you ever been:

Refused a visa
Refused entry at the border
Refused permission to stay or remain
Refused asylum
Deported
Removed
Required to leave
Excluded or banned from entry

firstly I ticked NO but then we realised she was initially refused ENTRY CLEARANCE VISA. we appealed and Visa was GRANTED. we have since extended the visa for the 5 years routes.

question is (should we tick NO or YES???

please help

kind regards

Lucky

The question is self explanatory.

If you have had a visa refusal from any country including the uk, you should tick yes.

Well if I knew I wouldn’t ask @Cr001.

more question please.

1)Bank statement wasn’t stamped or signed by the bank. Should I be worried about it?

2) do I upload all 12 months bank statements or just the pages with my wages?

3) finally should I get a letter from the landlord or the Assured tenancy agreement is enough?

Many thanks
Lucky

1. If these are in pdf format and look original then should be fine without stamp. 2. All pages. 3. If the tenancy agreement is joint named then no additional letter will be required

Attaching the 13th month (May 2019) payslip for counterbalancing the deficient pay of April 2020 won't be considered. Also as stated earlier that lowest wage during the last 6 month applies when you apply under category A salaried person but you are actually relying on category B and the total of your 12 months (June 2019 - May 2020) seems sufficient. Just make sure to get get the employer letter stating your annual income which if will be at least £1860 then despite you were paid considerably less in April 2020 should fulfill the requirement. I hope it now fully clear.

Hi Seagul,
Been thinking 🤔 about your last reply. You have seen my payslips for the last 12 months.
What’s your advice and what Category should I use?
Cat A or cat B.

I am really broken atm. Thought I was done few days back and now I’m over thinking and things are just coming up left and right.

Pls help me out here.

Thanks seagul.

One more question please.

I received a letter from the Estate agent about my tenancy.
Contract expires in July 2020 and I am applying for my wife ILR in June 2020.

Letter stated “periodic basic” . I have also scanned the Assured Shorthold Tenancy agreement.

I am not planning to renew my agreement as we planned to move Closer to work after the ILR.

Do you think that will be an issue for the application?

Kind regards

Lucky
