Contacted European Commission and explained them everything and they revert back to me saying same that once i have right to access minor child in the host country my retention application cannot be denied, my right of retention of residence is not conditional upon EU spouse working or not. They also added that i have to be employed or self employed or having sufficient funds not to be burden on state. They also mention in email that in the event my retention application got refused i have to contact them straight away and they will guide me further and to send the copy of email to INIS with the retention application form.
