Apart from the legislative issues, unlike HSMP pre Nov 2006, the applicants provide an undertaking on the form that their further application for extension etc. will be subject to the immigration rules in force at the time of such application. Although, a rule which plays with the lives of so many ppl can not be subject to a casual treatment.wp2tier1 wrote:Well there have been two successes of JR on restrospective changes:
1. Related to hsmp changes being applied retrospectively.
2. ILR rule of 5 years being applied retrospectively and the basis for win in this case was that the documents on hsmp said that ILF would be granted in 4 years. So on same line the documents for tier 1 currently say that you get ILR in 5 years. So why would govt risk another JR loss and apply it to those who are already on tier 1? If they do then why can't another JR be won based on the documentation like in previous case?
See the latest bill which is being discussed in the parliament at the moment. The bill stipulates that if you do voluntary work after PC then you can get citizenship in 1 year rather than 3 years (so 5+1=6 or 5+3=8yrs).letmec2006 wrote:The path to citizenship (2008) document clearly states for an econimic migrant, need 5 years on temporary resident and 1 year on probationary citizenship after which one can apply for citizenship. Where is it mentioned of 8 years???
Yep. Clean the roads,do work without pay,do charity work, teach computers to people etc to get citizenship early. That's what it is coming to now.push_hsmp wrote:See the latest bill which is being discussed in the parliament at the moment.
