tier 1 general closeure for oversease from 23 dec 2010

How can someone take a decision on such a short notice?? .. I was preparing the documents in order to apply on the 27th and my new passport did not come in yet .. it is so unfair !!!
.. is there any way we can ask them to extend till the end of the year ??

Dont worry...........You can directly walkin as well. I suggest you go to VFS which is in Grant Road as it will be less corwded. The only difference between walk-in and appointment is that one without the appointment will have to wait for a longer time for the process to be completed....so HURRY UP!!!

Some one explain this...


When the temporary cap itself is deemed unlawful, how can they close on the below reason.

*****This is to ensure that we do not exceed the limit set by the government for issued Tier 1 (General) applications between 19 July 2010 and April 2011*****


I was about to apply tomorrow, but got shattered by the decision

The cap itself was not deemed unlawful, only the way it was introduced was declared unlawful.

Further to this, my understanding is as follows:

Because of the way the cap was introduced, the cap was unlawful. They did not re-introduce the cap for Tier 1, but instead closed it because it would exceed the limit that government had set. They could have closed it because Damian Green felt like it too - the fact is that they have legally closed it this time - the reason is not what is of importance.

In fact, I do believe that based on this, if they were to exceed the actual limit (which I doubt they will because the stats they based it on was a bit skewed), they would have to process regardless.

so if they haven't met the cap they set earlier in the year how can they just close off any more applications with about a days notice... surely there is some sort of avenue for appeal, these guys are constantly moving the goal posts on us... and we're carrying this country...! (kind of)

It had to happen sometime in the future, based on the sentiment of govt, but the short notice surprises me !

Since the cap was deemed unlawful, the only way government could keep the number of Tier 1 (General) migrants from overseas in line with those announced at the time of introducing the cap in July (5100) was by closing the scheme altogether.
Written ministerial statement wrote:We should not continue to accept applications under the existing route if they cannot be granted once the current interim limit is reached. We expect, taking into account current trends in applications and refusal rates, the interim limit to be reached imminently. The Statement of Changes to the Immigration Rules therefore removes existing provision for the granting of entry clearance in the Tier 1 (General) category.
Just an alternate "lawful" way to achieve what they had hoped to achieve through interim cap (which was deemed unlawful on a technicality).

The closure has no affect on dependant applications made by dependants of existing Tier 1 (General) migrants.

I do not agree with sushdmehta. There is no indication of "some" in Damien Green's statement. This is another interpretation of how individual see it. Need to wait until all the details are announced.

The question asked is to apply for a NEW application for dependent route and you quote something from SWITCHING into the dependent route. That is not a correct quote.

AFAIK new applicants into the Tier 1 dependent route will not be affected and application can take place as per usual.

This is terrible news and a terrible way of announcing it. Only giving ONE DAYS NOTICE??


I'm glad I got my application in a few weeks ago, but I cannot even imagine how terrible this is for a lot of you guys here!


What happens if my application is denied at this point? I'm basically screwed?

Assuming a refusal:

If you believe the refusal is due to a mistake at caseworker end, then you may apply for administrative review. If AR is also refused or the initial refusal itself was for valid reasons, then yes, you are (as you said) "screwed".

I applied on 22-Dec via online and the system is given for inperson documents on 8th jan. I am confused with this. Still can we submit our docs in india on 8th Jan.
