EEA family permit is a form of entry clearance, which you will need in order to ENTER the UK, and can only be applied for OUT-COUNTRY.

In order to REMAIN in the UK, you will need to apply for a Residence Card ('Residence Document' in the 2000 Regulations).

It depends on whether your spouse/partner is EEA (NOT UK) national. If yes, you will be able to apply for a Residence Card even if you over-stayed in the UK.
