WP Need to fight for their rights

I think the WP holders should take the help of the HSMP forum experts and fight for their rights. I am sure the HO would not like another case in their hands and lose the same.
If the HO was ethical and moral, then they would apply the same ruling for WP Holders.

WP forum should file a case asap with the help of the HSMP experts/ barristers to gain the same benefit. The members could contribute for the cause. What does the group say??

FOR WORK PERMIT HOLDERS

I have raised a new Petition to the Prime Minister and it's awaiting approval. The text for the petition is as follows:

We the undersigned petition the Prime Minister to ask the Home
Offices’ Border Agency to apply the original conditions for
Indefinite Leave to Remain for all those who were work permit
holders before the policy change in April 2006.

In April 2006, the Home Office retrospectively changed the
conditions for Work Permit and HSMP visa holders, extending the
requirement to achieve Indefinite Leave to Remain (ILR) to five
years instead of the original four years they were promised.
The retrospective change to the ILR requirements was challenged
in the High Court by a group of HSMP visa holders (HSMP Forum
Ltd) through a judicial review. The judgement on the 6th of
April 2009 requested the Border Agency to apply the original
ILR conditions to all pre-April 2006 HSMP visa holders. Since
Work Permit scheme was also a route to ILR, we request the
Prime Minister to request the Border Agency to apply the same
conditions to those work permit holders who were originally
eligible for ILR in four years (pre-April 2006).

I will post the link as soon as the petition is approved.

Dear All,

The HSMPians won the JR! Thanks to the HSMP Forum, the retrospective application of policy changes by the Home Office might stop but the '4 years to ILR' should be retained for pre-April 2006 work permit holders as well.

In a bid to get this issue to the attention of the Prime Minister, please help and support by signing the following petition: http://petitions.number10.gov.uk/workpermit-ilr/

Thanks for taking this up.

Can you explicitly cover (in your petition) for cases where people with work permits prior to April 2006, and may have either continued on work permit OR switched to HSMP categeory later!!!

There are likely to many such cases (including me) because HSMP provided the flexibility to change jobs.

Thanks for your note, Girish. Our petition covers anyone who had a workpermit before April 2006 and this includes those who switched to other immigration categories.

Also, our petition should be supported even by post-April 2006 WPians because retrospective application of immigration policy changes must stop not just for us, but for everyone!

Hi Mervin,

You deserve a huge 'Thank you'! And i am so glad that work permit holders are doing something about it at the moment. I just signed up on the link and hopefully it helps. If the '4 years to ISL' applied to all pre-April 2006 work permit holders, then i will be entitled for ILR this December! One year shorter does make lots of differences and lets keep our fingers crossed!! Of course, if it applies ot HSMP, then it should applies to WP holders too!

Its an great initiative from Marvin, there are many people around who came to UK on workpermit and switched over to HSMP at a leter date. Many people were on WP before apr-06 but switched to HSMP later. As immigration rules were supposed to be same for both HSMP and WP.

I had joined the e-petition raised by Mervin and would like to encourage people to join the same..

Prior to 3 April 2006 the continuous leave requirement for indefinite leave to remain (ILR) under the highly skilled migrant programme (HSMP) was that migrants should show that they had spent four years' continuous residence in the United Kingdom. The four year qualifying period was increased to five years' qualifying residence on 3 April 2006.

The HSMP Forum Ltd brought a Judicial Review against the Home Secretary on the basis that those who entered onto the HSMP before the qualifying period for ILR was increased from four to five years, should be eligible for ILR after four years on the scheme. The judge found in favour of the HSMP Forum on this point. A copy of the judgment can be found on the BAILII website, on the right side of this page.

We are currently looking into implementing the court's decision. We will publish our remedies as soon as they are finalised and migrants who believe they may be affected by the judgment should check this website regularly.


From Judgement release on 8th April 09 :-

IT IS FURTHER ORDERED that the Defendant shall implement this judgment as soon as possible and in any event within 42 days of the date of this order.

Urgent Request to all WP/HSMP Holders Before April 2006

I have written to UKBA, Lin Homer Chief Exec UKBA and my local MP about my concers in relation to Workpermit holders who came before April 2006. I would urge all of you to do the same. Atleast something should continue happening in a coordinated manner. Thnx

This news item follows on from the news item published on 14 April 2009.


The Court Order, dated 8 April 2009, in relation to the above judgment gives the UK Border Agency 42 days to implement that judgment.


Work is underway to put the necessary remedies in place. This is not a simple matter and it is right and proper that we take the time available to make sure that correct policy and procedures are in place for all those affected.


We appreciate that those affected will be keen to formalise their position in relation to the judgment but ask you not to submit an application based on the outcome of the judicial review, until policy and procedures are published on this website.


There will be some people whose leave is due to expire before (or shortly after) the policy and procedures are published on the website. Those people will need to submit an in-time application. If this is the case you can submit an application for indefinite leave to remain (ILR) and this will be held until policy and guidance is published. It would help if you can make sure you attach a note to your application identifying yourself as being affected by the ILR judgment handed down on 6 April 2009.


Policy and procedures for all those affected by the judgment will be published on or by 20 May 2009

i am now pretty sure that 4 years ILR rule is coming to effect somewhere from end of May onwards. Is anyone aware if that 4 years can be combination of BOTH Workpermit + HSMP ??

Work permit holders who entered before April 2006 who did not apply to switch to HSMP successfully before April 2006 do not seem to be covered. No surprise here then...

Hi guys,

I'm new to the forum and stumbled onto this thread which is of great interest. ...

I'm on an AV here (4 year) which expires next March do you think there's anything can be done there or have you heard of anyone getting involved? Obviously I'm livid at paying for fees so would like to avoid this if at all poss....
