Assalam-o-Alekum,

JazaKal Allah Khair for your update on the forum.

it looks really far   . But I still remember that I've to appeal my X Wife visa as well and I appealed some where in Jan 2010 and got the hearing date in November 2010. I guess that's the normal appeal hearing date and that's what normally the court people also say over the phones that it can take up to an year time for the final hearing date to come.

Allah knows how much more pain and how long more I've to wait   . I feel like my tears are also getting dry now.

Remember me in your prayers and I'll also do the same in my every Prayers.

Keep us updated on the forum.

Good luck to every one for their spouse visa appeal/applications/reviews.

hi brother

I was refused my application on my spouse income threshold.. my wife was refunded tax back from her 2nd employer as hmrevenue stated she was paying to much tax.. the employers accountant issued that months wage slip and also included the tax that was refunded back but he did not issue the tax refunded with the wage cheque he gave it as a separate cheque which were deposited into the account 2 weeks later from the wage slip being issued.. its refused on a minor thing it was the accountants fault.. the was just an explanation that needed to be given as to why there were 2 cheques.

the eco did not give request any further explanation he did not do his research and just refused the application because he could.. well I've appealed with all wage slips, p45 ,all bank statements copies of the cheques that were deposited all employments from hmrevenue and all record from employers.

Hi

I'm really hoping someone can give me some advise.

Applied for husbands spouse visa in Islamabad 03/12/2013
Visa refused 07/08/2014
Appeal submitted 05/09/2014

1st Tribunal date: 06/03/2015 - cancelled due to a lack of judges
2nd Tribunal date:01/06/2015

At the tribunal I went with legal representation. No one turned up from the home office, and the judge allowed the visa.

Decision was issued on 09/06/2015

I contacted the home office at the start of July and was advised that it could take 6-9 weeks for my husband to get a call letter to resubmit his passport.
I contacted my local MP who has contacted the home office on a number of occasions and been advised that actually it could take 12 weeks for my husband to get a call letter.

I have written to the Croydon immigration office - no response
Emails to the home office and the British embassy - either getting no response, or being told that the application is under process.
Phoned the home office to investigate and after a week was told 'under process'
My solicitor has sent letters and emails to the home office and the embassy but has not received any responses other than 'under process'
I have now also contacted one of our local councillors in addition to speaking with my local MP.

My husband has tried to contact the British Embassy over the phone, and is transferred to a number of different people before being cut off. He has also contacted the Gerrys office for information, but as expected there is only so much they can do.

I am sending a letter to the embassy today with a copy of the appeal determination letter, including the full report as I feel like I've run out of all possible avenues.

I know the visa process is never easy and certainly not always fast. But it has now been nearly 15 weeks since we went to the tribunal. We are due to have our first child at the start of December, which isn't that far away and I would like my husband to be here before then.

Any suggestions or advice that anyone could offer would be greatly appreciated. I don't know what else to do or who else to contact.

Hi,

First of all Masha Allah lots of heartiest congratulations on winning the appeal.

2nd thanks a lot for sharing your experience with us on the forum.

If I was you I think I should contact the Court and mention all the length of time which has already passed now in your husband visa case. They'll definitely help you in this situation as the decision was issued by the courts.

Would you also like to share the reason for refusal for your husband.

This is the biggest dilemma of this country that the immigration systems is in tatters. No body will listen to your voice no matter you go to your MP or where ever all I can say to you is just contact the court and mention this explicitly to the court that the Home office is not obeying the court decision which is a clear contempt of court by not issuing your husband visa.

Kindly keep us updated on the forum.

Remember me in your prayers and I'll also do the same in my every prayers.

Good luck to all.

Here is an update on my situation, it may help you abbsm:

Second application for my wife was made in January 2014, refused in September.

We appealed, court date was in May, we went and won the appeal.

A week later we were informed that the home office had made an application to appeal to the upper tribunal.

3 months later (22nd August) we were told this application was refused.

A week later I phoned courts to ask when my wife would be called they said contact the embassy.

So I phoned the international visa enquiry service (the one where you have to pay via card before talking) and they said they would escalate it. They asked for the usual details and said send via email. 3 days later, nothing.

I phoned again after 3 days (and paid again) and I said the same thing I said the first time, he tried to fob me off, saying I should email the details so it could be escalated... this is when I lost my patience. I explained how I had been married over 3 years, had a 2 year old kid, I applied twice, got rejected twice, went to court twice etc etc. He then said give me your case number (it was in the automatic response I got when I emailed my details to the enquiry service) and he said I definitely would be contacted within 3 days.

Next morning I got an email saying my wife would be receiving the call letter in the next few days.

Today my wife got a call asking her to confirm her address. They said they will posting the call letter today.
Applied in Islamabad: 03/07/12
Refused: 14/11/12
Appealed: 26/11/12
Court Date: 02/09/2013
Appeal Unsuccessful.
Re-applied in Islamabad: 20/01/2014
Refused: 15/09/14
Court Date: 09/05/2015
Appeal allowed.
Awaiting call letter.

Thank you for your response.

Following from seeing your post this morning, I received an email from UKVI advising me to contact the courts as well. The courts told me to contact the foreign and commonwealth office, who directed me back to the UKVI. I spoke to the UKVI, and was told that they don't ever issue call letters... Sounded like she just wanted to get off the phone. Anyway, she suggested that my husband go to Gerrys with the determination letter, as that is apparently all that is needed to submit the passport. He has tried this before, and failed. But I asked him to contact Gerrys again to ask, before he made the journey. As expected, they told him that he couldn't resubmit his passport without a call letter. So I phoned the UKVI back, and spoke to a much more helpful man who advised that a call letter should have been received by now. He has escalated the enquiry as a priority for me. He also recommended that I wrote an email via the online gov.uk form, and he told me exactly what to write. I have sent this email, and hopefully might get something more than 'under process'

My husbands visa was refused because my second job was considered not genuine. I had provided 8 months bank statements and wage slips at the time. But I guess sometimes the ECOs for whatever reason miss out certain documents. When I went for the appeal I provided letters from HMRC to prove my employment, and further bank statements and wage slips.

I also went and visited my MP again today. I'm trying everything I can think of really.

InshAllah we all get through this quickly. I know how hard it is to go through, and I wouldn't want anyone else to have to experience it. My duas are with everyone

Thank you for your response akhan47

I did contact UKVI today, and after being misinformed by one of their advisers, managed to speak to someone who seemed to be a bit more helpful. He advised it has been escalated as a priority. I just hope he was being genuine.

I'll update with any information I receive.
