Hi everyone!
Just wanted your advice on my situation, please. I am on tier4 visa till October 2013. My 10 years will be completed in February 2014. I have my family(wife and three children) as dependents since 2005. I want your advice that if I apply private life visa as my children are living here for than seven years before end of my current leave. And of course it will take many months before ukba will decide my application, and i will complete 10 years during that application. Would it possible to apply for ILR during that application? Please.

Please explain your back ground history, what visas were you on since entering the U.K?

@r4rashed,

You have availed max of 8 years being a student. Therefore you cannot apply for further LR on Tier 4.

But there are exceptions for certain Subjects and studying at Post Graduate Level at a a recognized institute.

Please follow this link:
http://www.ukba.homeoffice.gov.uk/visas ... /how-long/

Exercising your right to Private and family life is not an easy route, you'll have a stronger case when your 3rd child born in the UK becomes 7 years of age in April 2013.

You can file FLR(O) at the end of your residency period along with your dependants requesting, 'Bridge the gap between the expiry of you Tier 4 visa and your qualifying period for ILR'.

It will buy you some time anyway, if application process time remains at 6 months.

Tks st. I Have a concern, i applied for ilr 10 yr in July. I had one gap may be two. In 2003 i Have a gap of 12 days. Application for the extension was submitted By the uni in 2003 . However, fortunately i found that there was a postal strike at that time. I sent all the BBC articles related to the postal strike with application. The other gap occurred in 2007. This is when i applied for a visa i used the wrong form. They returned the application as invalid. My leave was expiring on the same day. I posted a new application on the same day. I sent the Royal Mail receipt to prove the fact. Though i Have got the necessary, there is still a doubt in my mind. Am I having a realistic doubt???

With FLR(O), you include a cover letter explaining that you have lived in the UK for certain amount of time along with your family and short of 2-3 months to qualify for ILR under 10 year LR.

You will have to consult an immigration solicitor to discuss the pros and cons of filing FLR(O) to Bridge the Gap.

Calling all July Applicants

Post by Hwima » Sat Dec 29, 2012 2:05 am

Hi Softmind82

I'm one of the July applicants. I was a little hopeful we would get some response last week when a few May/July applicants got their approval notices. I sort of expected my application to take long when i applied for settlement but not quite this long. My situation is complicated and i feel i'm going to need some luck to get through this which makes the waiting even more unbearable unlike the majority who submitted straight forward applications. Wish you all well

July Calling

Post by tapi98 » Sat Dec 29, 2012 3:05 pm

Still waiting also submitted mine on the 20th July. Straight forward case 8years 6months student and 2years Post Study Visa expiring end January 2013.10 years living in the same place.I hoped that the Homeoffice was going to give us something to cheer for during the Holiday. The feeling of seeing post man coming and dropping something on your door. You run and check and you see they are just letters you are not expecting kills.I bet they do better 6 month without your passport is kind of indirect torture of the soul. But we don't loose hope we came very far 10years in this country renewing Visa is frustrating than the 6month soul torturing they are putting us on.
