As per my previous post:

I would suggest you to call UKBA on 0870 606 6677 and insist to speak to a supervisor, you have to be really firm on you request to speak to the supervisor.

They can provide you a specific address to write to your caseworker directly.

This is a tried and tested method.

Even August applicants are receiving thier BRP now who are SET(M). I wonder why SET(O) applications are taking so long.

Called them and the lady told me that decisions hasn't been made. She gave me fax number for the case worker unit in Liverpool. The lady said i can contact them regarding my case.

Call to UKBA

Just called UKBA to check if my application has been allocated with to a case worker and the answer was "Not in the system". Further the lady told me that it is unlikely that the October files will be opened this year as September Bio Invitations started showing up just few days back with Christmas holidays kicking in soon. Fantastic. Atleast I will not be making any calls to UKBA until 2nd week of January.

We (SET M) sent our app at the end of September and got the biometrics letter in early November. Guess we were just lucky.

Were you notified what team it is in Liverpool? If its a general fax number, then I am afraid your fax request will wonder about in Liv Set Office.

Ask for what is the team Number? .....LivSet 1, 2, 3...!!!

Hi guys,
I'm hoping someone can help clarify a few things for me. A mate has just put in an application for ILR, via set(M) as an unmarried partner of a UK citizen. They have been together for over 2 years, and are same sex partners. His partner meets all the criteria, and earns a very healthy income, but my mate lives here illegally, and has no prior status. But his solicitor seems to think a set(M) application is valid. I'm wondering if this is true, and that the solicitor might just be stringing him along to earn fees. He made the application in October, got an acknowledgement. He has also received a bio-metric invite, which he said was done late last month.
The question is: is this a valid application, bearing in mind his status, and no prior applications made. I'm concerned that the solicitor is a shyster, but my mate thinks it's all above board.
Are my concerns correct?

Hi Uchida,

Its complicated in your friends case, regardless of their relation due to one of them being illegally in the country.

The chances that when they file the application the illegal person gets detained(& deported to home country) by UKBA due to prior immigration violation and most probably this application will be refused.

Advise is for the person is to go back to the home country and apply from there.

Its best to take advise from 2 or 3 different renowned solicitors who specialise in spouse applications and then decide.

Thanks Spidery_thread for your quick response. I have brought this up with him, but he argues, that same sex relationships are illegal in his part of the world, and he cannot be deported to place hostile to his sexuality. Asides, he has been sent Bio-Metric enrollment letter, which he has done. I was going to speak to a few solicitors, but they all sort of seeks a fee before they issue any legal advise. My mate says, that the fact that he has done biometics, it means his application is valid.

Real application process starts after biometrics, this to confirm if the applicant has any criminal record in the U.K and whether the applicant has made any application/s previously with the same name or a different name?

Biometric invitation letter doesn not mean that the application will not be refused later on. Its just a backlog of applications at the HO will buy him some time.

At HO, I have xperienced valid applications are refused and invalid approved.

This is a general fax number. From fax numbers you can not guess team number. It may have been the case that Liverpool Settlement Office fax number has been masked by 0870.

To avoid location detection, this seems to be a new fax line.

It's getting close to 6 months for me...

Visa: Set(O) (I arrived on HSMP in 2007, then converted to Tier 1 (general) in 2009)
Application Date: June 19th 2012
Biometric Registration: August 9th 2012 - completed August 10th

My situation is a little complicated, as my job requires me to travel extensively (mostly short trips to Europe) and I've been stuck in the UK for 6 months, creating no end to anxiety for both myself and my employer. Luckily, they are understanding. I tried to get an appointment, but none were available.

The application itself should be straightforward, I qualify with plenty of points to spare; I think I've given them all the evidence they ask for. The only complication is that I've been out of the country a reasonable amount. This was never for long, extended trips and was almost entirely work related (I was never subcontracting: I was always employed by a UK company and paid/taxed as a UK resident). I got letters from my employer supporting everything in the claim.

I've also tried:
  • An inquiry to the UK Consulate in NZ (where I'm originally from and my company has it's global HQ).
  • An inquiry to my local MP; he then raised it with the (then) minister of immigration - Damien Green. The basis of the letter was that by preventing me from travelling, I was unable to help my company grow and employ more people. It seems this is not a good argument.
  • Ironically, Damien Green's letter back told me that I could expect my application back on December 19th (exactly 6 months after I applied) and gave me a number to call - who, as you all no doubt know - won't talk to you if your application has been outstanding for less than 6 months.
  • Based on the above, I wrote to UKBA to ask if my application could be sped up; the answer is no.
  • I also asked if there was any way I could get a new NZ passport issued and travel on that. The NZ Consulate would readily do that, but I was told I'd get turned away at the border.
I'd love to raise this as a much more public issue, but given the current hate of immigrants, I doubt I'd get much media traction or support from the general public.

I have a sneaking suspicion that UKBA staff were seconded to staff the border during the Olympics.

Current average time for SET(O) application to process by HO is exceeding 6 months.

The best thing was to write to the case worker directly and explain the situation. As far as your time spent out side the U.K is nature of your job and HO allows descretion in these circumstances as long as you fulfill all relevant immigration requirements.
