Salaam brothers and sisters,

New to this so apologise for not having a timeline.

I feel your pain, i applied in March 2015 got a refusal in May 2016 and then appealed. I was declined on 2 things. Firstly discrepancies in English certificate which has been over turned and secondly not meeting financial requirements however i do but for some reason they think i dont and did not even look at my supporting documents.

My review sate was 3rd november 2015 but i heard back yesterday with the regusal and a court date set for 10th June in Bradford

Im really sorry to hear this brother but the only good news for this would be for the people who were denied visas for the sole reason of English certification confirmation can have faith that they have a good chance of their refusal being overturned

Yeah i suppose that is true. But that was a mistake on their behalf as my wifes first test was cancelled due to security reasons so she completed it on another date but they did not change the date on the system. This has been solved for me Alhamdulillah.

Just annoyed that they refused on financial requirements and are have refused on something that is nothing to do with my case! Does anyone know if i can get the Home Office to look at my case again as its a straight forward mistake and my supporting docz confirm i have been emplyed by the one employer for the past 4yrs

1) Brother how do u know they overturned the decision on English test issue and not overturned on financial grounds?

2) Did they mention all these details in their appeal bundle sent back to u?

3) you came to know yesterday that they issued u a court date but can u tell which date embassy wrote to court about their decision?

On the review decision my solicitor recieved it states on there. Basically on the English they refused as the certificate date did not match what they held on the system. Thats due to them cancelling my wifes first test but them not changing the date on the system and inputting the correct date. Theres emails the review officer sent to city and guilds and vice versa attatched to support that it was their mistake.

10th of September the entry clearance manager made his decision. I do not know when the embassy wrote to the court

I have been to see my local MP who said he is going to phone the home office as its a straight forward mistake and hopefully will get an entry officer to look at it as they don't like going to court if they know they are going to lose! So Inshallah fingers crossed maybe done a lot quicker than June next year

I have made a separate topic to help this who have been affected by this Cambridge English test fisaco, I will provide as much information as others and I'm sure others will too who are in a similar situation as we may be the first but we won't be the last people affected by this

I'm supposed to hear back regarding my appeal within the next month but from what I have read, it seems unlikely they will respond so I should expect it to go to court
Our app was rejected on financial requirement but I checked with two immigration solicitors before applying, and then two different ones once I got the rejection, to confirm we met the criteria.
It's a difficult situation but we rely on Allah in times of ease and difficulty.

I received a letter from my MP today basically telling me that they won't look at the evidence even though it looks correct and the original decision made was wrong and all I have to do it appeal

Hi Brother,

I am fairly disappointed to see the reply from your MP.

But I am not surprise at all you also looks a bit naïve to me when it comes down to dealing with these bureaucrats. When you posted this that you've contacted your MP and all those efforts I knew from that point it was a completely useless attempt in this direction.

I work for a Government Dept sadly and deals with others on a daily basis. They are all useless gits. that's the best way to describe them to you in plain words.

Once u get your deadline I'd say if u don't hear by the 9th week then it's court...

It's really quick bro ECM wrote to tribunal on 5th October and your wife got the letter from tribunal on 8th October.
It seems like BHC Islamabad might have emailed or faxed their decision to tribunal on 5th October.

No as you count from when the ECM's office receives/ us sent the appeal package which is the same time you receive your deadline notice
