Who was lumping all EU1 cases together?

I would expect DOJ to want to do that, especially if they have one test case they think they might be able to win.

But were the court's also lumping things together?

The judgement on the Kumar Case from the High Court.

Even though there is a passing reference to JIA which Clearly states that E.U States cannot make prior E.U residency a condition, the judgement goes on to say that Ireland can require prior residency in a classic example of circular logic.

......and that was/is the ultimate purpose of Regulation 3(2) of S.I. No.656 of 2006.
