Does anybody here know if the new Immigration Bill is passed will it have any effect on the already won HSMP Forum JR and the ILR JR (if its won?). Will the bill nullify the past judgements? Also, any idea when will the bill come into force? immediately after it gains royal approval or is there a set date?

The Parliamentary Joint Committee on Human Rights in its recent report stated as follows in reference to our April 2008 Judicial Review Judgment; "The High Court held that the terms of the original scheme should be honoured and that there was no good reason why those already on the scheme should not enjoy the benefits of it as originally offered to them. The generality of this reasoning seems to be as applicable to the April 2006 changes as to those made in November 2006.(pg 50)"

Yes, and the judgement adequately addresses this concern (I believe).

But you are wrongly assuming that you were promised ILR after 4 years when you applied (between Apr06 and Nov06), because post-Apr06 the guidelines "clearly" mentioned ILR qualifying period as 5 years. And this judgment binds the government to let you apply for ILR after 5 years of continuous residence in UK (benefit of scheme offered to you at the time of "your" application).

Had to apply for and was approved 3 year extension under old HSMP till nov 2011.

What is the Present status?
Do I need to wait for the implemetation of judgement.
Am I eligible to apply for ILR now or
will I become eligible to apply for citizenship in November

Hi gpawank, we have nearly the same timelines! Yes, you have to wait for the implementation of the judgement. Judge gave HO 42 days to sort this all out, so let's wait until end of May.

Meanwhile, you and I are still HSMP/Tier1 visa holders. I hope we get citizenship in November.
