I haven’t received the HO bundle for the appeal. And I don’t think they sent their bundle to the court either. I rang the court and I was told that the appeal is ready for a review but they haven’t got enough Judges available for paper appeal. Have you heard from them? Best wishes! Stay safe.

From the conversation I had with my lawyer this morning the request was made 2-3weeks ago she did not bother me as she had all the information required with her

Home Office is still working and decisions are coming in.

Dont worry friends, soon your decision will be received and all will live happy afterwards.

Mubashir1981, for the HO not to respond to the court bundles means they are not interested with your appeal because they know they refused your wrongly and know the judge will allow it.

As I keep saying, Zambrano derivative application is in the mercy of the courts now as HO is making it difficult to people to apply.

They know the guidance isn't driving people away and the only to drive people away is to refuse. Only few will go to court to seek justice.

I received this email from HO this morning;

Due to their complexity, paper applications are considered by our ‘Specialised Applications’ team and do not fall under the standard processing times. I got reply for my email from court

The matter has been allocated to a judge but is yet to be heard.

Due to the current pandemic, the judges are working remotely so I am unable to provide you with a realistic time frame for when you will receive the decision.

I got a responds through my MP from HO after about 11 months of submission (applied june 2019).
The HO said ,my application is under consideration as they need to do more verifications b4 given me a responds. That we still have 15months more for EU to leave the UK so I need not panic .

Also due to COVID19,most application are gradually being treated slowly because low staff.

Fingers cross,I pray I should be granted the ILR because my second term of 2.5years *making it 5years) will soon expired in February 2021.

Yes I applied on the 08/08/2019 and received my COA In November and since then only the request for further evidence so still waiting no I don’t have a leave to remain I am an asylum seeker

In August 2019, I applied as a Zambrano carer under the EUSS based on the advise of HO when I called to see if I qualify. Biometrics was done and COA received in September 2019. I’m in a bit of a limbo as current leave expired 11 April 2020 whilst application is with HO and I’m yet to get a decision.
My worry is what happens if my application gets denied as my current leave expired almost 3 weeks ago ?

From my understanding, you have had Appendix Fm as the Parent of a British child twice and all granted and successful.

My question is you only had 2 more set to finish it so why didn't you follow that route.

Anyway, since HC1919 about Zambrano and Derivatives Right who could apply under EU Settlement Scheme since 1 May 2019.

Home Office has kept changing the rules of the game since then and many people are not catching up with the laws especially when HO secretly insert it like Section 2(a), (b) sub sec 1a. This get most people confused as it make it hard to follow laws. (This a scenario)

You have a precarious application.

Your position is really shakey and your merit in percentage is 30% you and 70% to HO.

Your application is fall to collapse as you have hard 2 successful domestic application renewal.

Remember, HO has made Zambrano route very difficult even for people who are and were already Zambrano and derivative holders.

Since 1 May 19 up to today, we haven't seen anyone been granted Zambrano EUSS without prior to holding Zambrano or derivative under EEA regulations 16

So prepare for AR as Home Office presenting refused people to go to court.

Though there's nothing stopping you to apply for the euss, the HO has made it clear that whosoever has been granted leave under appendix fm before would be REFUSED.

HO getting away with this because eu settlement scheme isn't under EEA regulations or eu laws and is 100% domestic policy.

To succeed under euss normally as Zambrano British carer especially, I always advise people to do Zambrano under EEA regulations first to enable you have a strong footing for appendix eu annex 1

Am ok, the biggest burden left my shoulders as you know on 24 .03.20 when my Settled Status was granted - though I had my new Zambrano eea granted back in October.

Home Office tried to frustrate me but the courts are fair and allowed my appeal to give me a firm footing for my settled status aka ILR

HI,

It is my understanding that a Zambrano application should take 6 months for it to be decided. Since the application is past 6 months , call the HO to find out why they have not still not decided your application in line with EU law as it is past the 6 months. I hope they have give you a decision sooner. Good luck.

It is unfortunate that I would have to say Yes to your question. The game keep changing every day.

Looking at recent EUSS data reports compare from 2018 to 2019 October, HO in the beginning never refused people with Eligibility. So within those months only 4 - 7 people got refused with Suitability. But after October 2019, HO refusal rose to 1000s and most were with Eligibility.

HO is breaching the goodwill of the WA agreed with the EU on both Welfare, Suitability and Right to Reside.

For the Welfare, the courts though acknowledged its discriminatory implementation but upheld in favour of HO under protecting public services. Almost like how Zambrano was excluded from benefits.

In actual sense, the WA and Appendix EU immigration doesn't have any law excluding people but clever HO domestic policies exclude people and direct people to go for basic care under Section 21 under the social act.

So Is YES. Most or all will be refused and those who could win their case are those who might get right of appeal to courts

Appeal under AR will be influenced by HO policies

Most lawyers claimed that, to succeed under EUSS as someone with Appendix Fm, you have to apply whilst your leave has expired and not when you have that leave. Moreover too HO new policy said if caseworkers marking decision and found that the person had appendix fm leave and that leave has expired with them and/or they have less than 38 days left then the caseworkers should grant leave under the euss.

So far HO hasn't lived to their promise and refusing people without their own guidance.

In all things, some people will still go through without any problem, this is destiny.

It is a good news. Phone them after 4 days to check your decision. Normally within 4 days the judge brings out his determination for HO to promulgate
