Hiya,

Just wondering if someone can answer my question. My hubby's come from pakistan 6weeks ago and is on a spouse visa for 2years. We both are planning to go to pakistan for 4 - 5weeks in November 2008 to celebrate Eid. I want to know how long can he stay there for? Are there any restrictions on the time limit he stays abroad?
Will this affect his ILR?

Perhaps Sammie1 can answer this question as she's experienced on all immigration enquiries.

Any one with answers please advise ASAP, as we need to book our tickets.

many thanks,

Going for 4/5 weeks should cause no problem for your hubby when he applies for ILR. Its only when people start going abroad for a few months at a time, they then have to apply for FLR extension to ensure that they spent as much of the two years stay in the UK

Hey hum786,

There is no specific requirement in the Rules that the entire probationary period must be spent in the United Kingdom. For example, where an applicant has spent a limited period outside of the United Kingdom in connection with his employment, this should not count against him. However, if he has spent the majority of the period overseas, there may be reason to doubt that all the requirements of the Rules have been met. [b[Each case must be judged on its merits, taking into account reasons for travel, length of absences and whether the applicant and sponsor travelled and lived together during the time spent outside the United Kingdom[/b]. These factors will need to be considered against the requirements of the Rules.
Don't forget the Knowledge of language and life in the United Kingdom requirements.

Hi Folks,

All the usual updates, nothings changed .... checked the website & called them up ... same information. The wait goes on...!!

Lion - whats the outcome??? the suspense is killing me ;-) hope its good news for you.

Faisel - good to hear from you - glad to see your having a great time in Pkn.

Lovebird/Maj - try to focus on the positives, and not what the failure reasons might be, and it will be easier to handle. Relax and keep believing ... as you can see pple are getting their outcomes ... albeit after a wait, some more than others ... but nonetheless they are getting their visas.

Sammie - thanx for the info ... it does help us all!!

Hi,

Took me a while to get through to my wife in the morning, but SHE GOT THE VISA!!!!! I didnt get the details so dont yet know what date the visa is stamped. Was very nervous but now absolutely loving it. Now comes the rush to get a ticket!
Took bang on 8 weeks, so all people around the 8 week mark should expect to hear something soon.

I hope you all get the news that you hope for very soon, Inshallah.
