Haven't been refused, zero communication from my employer yet. But looking above a comment mentions 50 being the cutoff

I think we need to bring this to the attention of the media.
Anyone interested in starting a petition on https://www.change.org/?
Hello everyone,I am an employer with four rejections in 4 months.I appreciate that some of guys have been waiting for about 5 months.I ve been sponsoring employees since 2011 and this is the first time that this has happened. It is frustrating ..yes!!but it is not going to change unless we take an initiative.
The conservative government does not want to increase the number of net migration to make their numbers look good.So Caroline Nokes the immigration minister had rejected the idea of shortage occupation to be considered outside the annual allocation limit of 20800 RCos.The last thing they want is businesses getting effected because of this. The truth is that it is the 5th month in a row that the allocation limit has been exceeded and businesses are getting affected!!!.Furthermore you guys are the last people they want to seen as stopping from entering the country as you guys are going to positively contribute to the economy. The last thing they want to seen is thier migration policy failing valuable members .If you doubt any of this please google the interview Caroline Nokes had given in January 2018 shortly after she had assumed power.I know this as you the people in this forum know more than some of the immigration solicitors dealing in your cases.
My MSP already is aware of the situation .If you get your employers to contact me directly ,perhaps togeather we could submit a petition for change.
Are you guys interested ???
I think if we can get some support from some prominent members and get 10,000 signatures. Parliament can then discuss this in the house (https://petition.parliament.uk/petitions/check). We need to however create and put fourth a valid argument.

Someone has tried before https://petition.parliament.uk/petitions/211456 but was dismissed.
Id love to submit a petition with you
Congrats to all those who got 50 points and above.

Canadarox and sadsadsad,I have already started working on a petition. The reason for refusal for the last petition was that the action needed was not specific.
Now we know the action that is needed;it is for jobs under shortage occupation to be considered outwith the annual allocation of 20700 RCos.The jobs that were not in the shortage occupation before are actually very much in shortage. The ones that were in the shortage occupation has actually got worse. We are also planning on submitting a complaint to Immigration minister Ccing as many labour MP s and newspapers as possible .If nothing we have atleast tried something rather than to wait and hope for the best.
It would be great if as many employees could join in on the fray but hey ho.

Hey Stephen,I understand your predicament mate.let's not forget that we are dealing with a government that has systematically and categorically destroyed evidence of stay for the windrush generation. These are people that came to Great Britains aid when it needed them the most.

Keep us posted. I'd like to get as much attention to this as possible. At least we can bring it to light. I was also thinking of getting the word out local MP's and London's Mayor Mr. Kahn who seems to be on our side with immigration.

I wonder if they cant accommodate the backlog of 45 when they have the highest allocation of cos would they ever be able to do in upcoming months. I see this as an issue to stay with more shortage occupation job taking the quota month on month

Long time reader first time poster. Will be applying next month for COS with 45 points. Looks bad. By my calculations there will be roughly 600 people on 45 points which makes it tough for the cut-off to drop to that in May. Why 600? Well in February the cut-off was 46 despite the fact that there were 201 certificates left over in Feb. That means we can assume let's say 250 people were on 45 (which is building up since Dec). Add in let's say another 150 new applicants on 45 for March. Same for April. Same for May. All these people + the 250 from February will be applying in May. if we subtract out the people from December since their RLMT would expire, it would still leave close to 600 people on 45 points. Could even be more but don't think it can be less. To clear all those 600 people on 45 in May it means they will have to reach down to 46 and have 500 certificates still left. What are the odds on that?

Any one can confirm how to calculate 6 months of validity of RMLT?
For example, my RMLT posted ads on 4th Feb, will it be valid to apply RCOS in Aug allocation month?

you are right but then this problem will be like a lingering one -every month it will add on and so are we saying the 40 plus will never get in at this rate and that is a serious issue - so cut off will stay 50 forever unless they borrow more from the next month and that should be the petition - they need to borrow more and clear else this is a endless saga

Refused at 45 pts
Thank you for your recent application for restricted CoS. Your application has been refused, as it did not meet the minimum points score for the allocation of a restricted CoS on the above decision date.

Check my earlier posts on the same. 250 can't be on 45 in Feb, it will be more than 201+100 at least.

in Feb, applicants in 45 band would be far more than 301 (more than 350 in fact), as 201 certificates carried over with 46 cut-off. This means 45 band could not be clear even after borrowing 100 certificates + a few on exceptional bases (350 approx).

In Jan, 115 carried over which means at least 250+ are in 45 band.

45 points band is not clear since December, i.e. 5 months!

Dec - approx. 150
Jan - approx.150 > 300
Feb - approx. 200 > 500 (from this month, employer started applying with higher salary)
Mar - approx. 200 > 700
Apr - approx. 200 > 900

So, I assume 45 band is badly stuck with 900+ applicants at least.

Usually, applicants are more at lower salary. So, think about how many applicants between 21 to 45 who are stuck since December!

I assume backlog is more than 5000 now, which is very difficult to clear in coming 6 months even unless HO can take some steps.

As per an article earlier, if they are planning to launch temporary worker scheme (max 2 years stay) for some 5500 NHS staff, it can be helpful.

NHS has to be removed from Restricted category, else all other industries will have challenges.

so this 45 will never clear which means that there is no hope for all till end of the year? scary they keep carrying forward every month and why they do not tell us total applicants every month by another calculation no one in 45 has got approved from Dec to April so how can others below even hope for a chance in May and this then is serious and calls for some action any suggestions apart from prayers!

Everyone relax and just pray that this adamant government and clueless HO does something otherwise we don't stand a chance. Already many employers increasing the salary to 50k to have a chance this will impact NHS folks who are not on shortage occupation.

Irony is for a tier 2 visa you have to follow so many procedures and in the last minute you don't get RCOS it frustrates employers as well as us.

They don't have skilled people and not doing anything on this staff crisis. Honestly people should think twice when they want to go to UK with life changing decisions.

not easy to increase the salary to 50 k as the RLMT has to have that range! so if u repeat RLMT - then you are out of that months race so this is crazy but there has to be some external step for all of us here at 45 and below else this is a painful story every month

If you have advertised for 47-49 it doesn't make that much difference to increase the salary. Even the 30% start doing that you ll have a big blockage. And there are companies like mine don't advertise the range they advertise it as 'Conpetetive salary' so they can increase the salary to the maximum band of that particular role.

Hi all - this board has been very helpful/informative so thank you for that. I am a first time applicant with 43 points (non shortage, 43K salary) and based on everything I have accepted that this is not my month, although I have yet to receive a response. My employer may be open to increasing salary so we can have a stronger application next month, but I wonder about having to re-do the Labor Market Test. My current LMKT did not list a specific salary band, but instead listed the salary as "competitive" so I am a bit confused about how that works. Would we have to re-do test to increase to say 50K? Or to 55K? Thanks in advance!
