Yes I will go :) I want my husband here with me! Hopefully they will look at my case properly and give him a visa!

I will take some more supporting documents with me to make my case stronger..

Wish u good luck,

but please remember you are NOT allowed to take any documents , u need to send them now, at least few days before the hearing, anything u take last minute in the court will not be considered!

Hi All,

Haven't posted in a while. We too are undergoing the appeals process. Our deadline is also March (they have until then to decide to overturn it, otherwise we should get the hearing date).

The wait is horrible. There's nothing we can do but wait now.

We got refused on the 13th October and sent our appeal off on the 17th October to the indian embassy. They did not overturn the decision and so our papers got sent to the uk on the 16th November and on the 5th December we got a letter with a hearing date for the 30th January.

I'm rather nervous about the hearing as I don't know what there going to ask me! I really hope I can convince them and they issue the visa!

Is there anyone here that can share there appeal experiences??

i have been for my hearing while i was in uk, i had applied for further leave to remain, but was refused
basically there will be a judge and a home office solicitor and judge will ask u questions and home off solc will try to advocate reasons why ur husb should not be allowed and u will have to give all possible reasons why he should be allowed to come to uk

Yes , this will be my second hearing, first time i had appealed when i was in uk, i was not married then , that was for a different category.
the judge had suggested that i go back to india and apply for spouse wisa/partner

they think i overstayed, my visa expired in feb this year but i stayed till sept as my case was in appeal
not enough proof of subsisting marriage and
did not provide tenancy agreement

Yes I am now in india mumbai trying to get visa and my wife is in UK, she is british citizen
where abouts are u

Ejaz who is also on this board has also got his appeal on 19th dec, his spouse visa has been refused just like ours, so you can get more detailed info about the appeal from him

yes chimpee my wife will be going to the hearing, have u hired a solicitor?

, I spoke to one and she said 900 pounds ( 400 for paperwork and 500 to represent) but my date is not yet decided .
infact i am hoping that my decision is overtuned :)

No have not hired a solicitor. I will go on my own! Solicitors will just rip u off and they do the exact same thing as ur capable off anyway!

Are u going to get a solicitor If your decision is not overturned??

Thanks and yah my family lawyer told me to choose safest option and that is to hire a barrister... and in meeting barrister said we wont have any issue winning appeal... hopefully his words comes true... i send all supporting documents related to my case to court.. which we have to send before 5 to 6 days before hearing...

Yes I suppose ur right. All my paperwork got sent straight to the uk from the indian embassy so they have all my paperwork

Do u think I should send any other relevant information such as recent pay slips and bank statements etc..??
