Do you have a right of appeal? What was/were reasons for refusal?

i havent had the letter yet. will have it tomorrow and will update you about everything. but for some funny reason i am so relax and not really bothered.
How long does it that to appeal?

I can understand why you feel relaxed now. The waiting itself is a torture so more like a big stone rolled off your head.It is well.
Hope someone can share with us the appeal timeline.

Not later than 10 working days after deemed/actual date of service, which normally is day you receive the notice

Its taking a bit longer now cos they got backlog.I submitted my appeal on the 27th of March and sent a request for expedited appeal hearing on compassionate grounds.I got a letter from the tribunal granting my request for an early hearing.29th July was the earliest they could get for me.I called them to request if they could bring it earlier than that but they said that was the best they could offer.
I will write another letter to push my luck and see if they could change it to an earlier date.Where you live could also be determining factor(guessing)

all my refusal was that his dad is there and can take care of him so that was it. nothing else. now i have gotten a letter from his dad and some payslips and passport. i dont know if i shd make a fresh application or still go on with the appeal

What is his dad's letter about and what will you use his dad's passport for?

his dad's letter is to explain that he has less time to spend with the child and his day to day up keep and the mother is the best person to do that. also that he is working and he has no time to be with the child

In their guidelines, they stated that unwillingness to take care of the child will not be considered. So the father writing that letter will mean you have contact with him and therfore the child too. My thoughts. If its for the appeal, then I think its ok. But for fresh application, he should be out of the scene.

Exactly that's the mistake my solicitor did he included the photocopy of my daughters dad passport. You have to insist u dnt know were her dad is. My lawyer mentioned gettn something from the court can't remember what he called it. It gives u full ownership of the child. Never mention that u even know his we're about that was one of the reasons for my refusal. Wat did ur solicitor say. I advise go for the oral appeal. If u reapply they will still give u the same story. We have to fight for our right. All the best

Mikilo, I can't understand why your solicitor added the photocopy of the passport. It was unnecessary. Anyway,that is over and done now. I believe you will be successful with your EEA2.
One thing is that a lot of solicitors did trial and error with the interim guidelines and never advised anyone when the rules were amended. We wouldnt have been left
in limbo now.
Successful appeals will eventually change their interpretation of zambrano. I hope it happens with their intended amendment in July 2013.

I was shocked when I saw the refusal letter that he included his passport originally we wanted to fill in the FLR o form n compassionate ground and family life that month the zambrano case was won and then that was an option but all the documents he prepared for the Dlr was included in zambrano. Those were the things pointed out for the bases of refusal. I believe we were used as scape goats

i would advice anyone applying or still waiting if it is not too late to allow friends and family who have stay or visas in the country and where they say to write a letter as evidence that they are the sole carers of the British child. i was refused because i couldnt prove enough that i am the sole carer. so when i went to see my MP he told me to get letters from frds and family to state that i am the sole carer of the child. which i am doing now before i send my appeal. that way i filled where i failed. i hope this help
