Hi guys
anyone applying for spouse visa

I did not obtain Uk Naric, just a degree certificate nothing else for english test requirement

I did not attest spouses passport copy or any other documents

I also did not carry out any inspection or anything, just provided copy of tenancy agreement

I do not suggest that u do the same, but it just depends on ECO and may not be compulsory

Cheers :)

Hi Guys

I am going to India this weekend and getting married the next. The only question in my mind now is the NOC from HO.

I remember I last heard that there is no longer a requirements to have an NOC or CNI when marrying an Indian National. Is this true?

I have all other documents required for the Spouse Visa, but I was just wondering whether I need the NOC/CNI to get the Court Marriage done in India or not or if there is anything else required for the Court Marriage...

Hi Harv,
U do not need a NOC or CNI to get married to an indian national. However to register a court marriage in India you do have to give notice of marriage. Have you done this?

Hi spiritz

You mean by the 30 day notice that is part of the Indian court proceedings right? Do they usually require such certificates (NOC/CNI) ?

If not, then I am covered.

One other question on the address proof.

I do not have the Council Tax bills and any other bills in the house on my name. Although my Bank statement, mobile phone bills have my name and address. Do you think that would be enough as an address proof? I have other documents that show my name and address - Tenancy agreement, letter from landlord, housing report and the sponsorship declaration.

Do you think I would need some other bill/letter to show my proof of address? I also have my driving licence's Counterpart (the paper bit) that has my name and address on it as well, should I also include this?

@harv
Im assuming that are getting married using the special marriage act of 1954 to get married. You mentioned that ur going over this week and getting married the next so just mentioned notice thing so u have covered everything.
As for the NOC it is a requirement but I was never asked for it I guess its up to the registrar.
NOC can obtained very easily(PM if you need assistance).

The tenancy agreement and bank statements should be fine.

Hi mtech25

Yes it may take up to 3 months to get an answer in some cases. I was in the impression that UKBA was dealing with cases rather quickly for this period (November and December), I guess I was not correct. As long as your application shows Processing at BHC or something similar you should be fine. You can ask for further details on the completion of 3 months hopefully. I hope you get your visa before 3 months.

In terms of not exchanging emails after the application, it does not matter because the evidence looked up in your application is until the date you applied. So anything happening after that should not usually make much difference if it is not really big i.e. change in finances, accommodation etc.

Spouse and 2 dependants settlment visa

Post by dominoe » Tue Jan 24, 2012 12:29 pm

Hi Guys

Firstly a thank you to the community for coming together to help each other through the stressful times.

Just wanted to call upon your experience for my case.

I did a religious marriage in Nov 2010 to my wife who has to 2 girls. We have known each other for some years and have provided adequate proof.

I have been seperated in the UK from some time and my divorce was complete in Oct 2011. I then went to India and registered my marriage in Nov 2011.

On Nov 21st we signed in the registrar office and submitted all necessary ID's and the Nikaah (religious document)document as well for the registration. I left India on a night flight on the 21st.

Question.
My wife received the certificate of marriage detailing our nikaah in 2010 but the certificate of marriage is dated 29th Nov 2011. Is this quite normal?

We have submitted at VFS mumbai north all documents on the 13th Dec with lots of proof of our relationship including maintanance payments, etc.

Any advice to put my mind at ease would be most welcome.

thanks

Hi mtech,

My husband applied on the 15th September at VFS Jalandhar and we got a reply on the 13th October. So it depends on every individual case. If you email them before 30 days then they will give you the same reply all the time which is 'it's still under process'

Hang in there, I'm sure you will hear something soon!
