Hi,

I moved to UK in Dec 2011 which was 15 month after I got my visa(sept 2010).

Got my visa extended in sept 2012 (first extension) until Sept 2015 (3 yrs)

Now I need another extension in Sept 2015 before I can apply for ILR.

If the visa extension closes by 6th Apr 2015, then can I apply for an extension 6 months before expiry of my visa or how can I go about it ?

Hi

I moved to UK in Oct 2011 and short fall of 11 months (Nov 2010),got extension for 3 years in 2012.I need to go for one more extension in 2015.
If they are closing the extension in April 2015 ,do they accept application 7 months prior to the expiry date of my visa.

Yes ,as long as you fulfill the visa requirement,it's fine for prior extension

but that would mean to score points, we hould have same salary in 5 months time, as salary points is 12 months before visa expiry, which would mean needed salary in 5-6 moths to be able to apply in april 2015..

Tier 1 (General) Extension until 2015

Current status: Tier 1 (General)
Initial grant: 16th Aug 2010 – 16th Aug 2012 (2 yrs)
Date of first entry into UK: 6th Aug 2011
Extension in UK: 16th Aug 2012 – 16th Aug 2015 (3 yrs)

Due to job crisis in UK, I delayed my entry into UK by almost a year. So there is a shortfall of 355 days before I can apply for my ILR. My second extension would be in Aug 2015. Following on from recent news about changes being made to Tier 1 (General) extension in April 2015 puts me in a soup unless I apply before 6th April 2015 which means there will be a further shortfall of 5 months over & above 1yr. Based on above I have few queries.
1. Is it possible to apply for extension 6 months before expiry of my visa?
2. If approved, for how long will be further extension 2 or 3 yrs?
3. What happens to Tier 1 (General) dependants? There is nothing in statement of changes which talks about dependant
extensions. Will they be allowed to extend indefinitely?

Any comments highly appreciated. Thanks

1. Yes you can apply early, even as early as 6 months.
2. Your 2nd extension should be for 3 yrs. See 245CB in immigration rules. Search the forum and you will find experience of some ppl who were granted 2 yrs in error and then got it corrected to 3 years.
3. There is no indication thus far that dependant applications will be affected.

Note: that said, the changes that extensions are to end in April 2015 is still not implemented, it only says 'changes are being made to signal'

Reading on from 'Statement of Changes' that looks to be a definite way forward, till then we hold on to our horses before jumping to any conclusion.

This is now official 5th April 2015 will be last day for Tier 1 Visa (General) extension.

Be warned and plan ahead of time.

It's very unfair,all the previous ppl had chance
To get 2 nd and 3 rd extension ,and now we are so tight cornered.we are just so helpless

Hi Guys,

My 1st tier 1 extension is expiring on Dec 2015 and I am short of 4 month to become eligible for ILR. Therefore I need 2nd ext to cover those 4 month, as the hom eoffice has decided to end the tier-1 ext by 6th april 2015, can I apply for early extension i.e in march 2015 although my first leave to remain expires in Dec 2015? Because early extension will provide my enough time to cover the gap.

Looks to me like scaremongering. Please don't post anything here without any basis or just based on speculation and assumption.

@Go12 it makes 2 of us, and its usually not possible to miss important news by 2 people?
this time even Fee was not increased, and for any such change home office declares well ahead of time, which is in all our case is 6th Apr. So according to me its good news for us Tier-1 (General) visa holders.
Unfortunately this Forum instead of helping fellow members is raising panic and utter confusion.

You need to go to sec 7.5

7.5. The Tier 1 (General) category, in which applicants scored points for their
qualifications, previous earnings, age and UK experience, was closed to new
applicants in April 2011 but remains open for extension and settlement
applications. The following changes are being made to this category:

- Changes are being made to signal the Government‟s intention to close the
category for extension applications on 6 April 2015, and for settlement
applications on 6 April 2018. This should give enough time for applicants who
entered the category before its closure to apply for settlement if they can meet
the requirements to qualify;

ThTs just statement of change.signal and intention does not mean it's a definite rule.it should be officially declared on the site.abhishek the irony is only we both are trying to find things out.

@amahmed85, @Go12 is absolutely right.
We are very well aware of link you just shared and we both were concerned for further news based on this.
Even there was news for Fee increase which again NOT officially implemented yet, but good news is we can't see any change in rule, and hopefully wont for coming year or at least few more months.

I just checked now on the gov.uk this morning it is official now 6 April 2015 is the last day for tier 1 extension.

My current leave to remain is expiring on Dec 2015, can I apply for early extension before 6th April 2015 let say in March 2015 and if yes how in the 12 month income will be calculated.
