my advise will be to go back to the accountant you used initial and extension applications, they prepared paperwork for your applications in past and have better understanding what correction required.

In both cases they will check five years HMRC record. People think if they will apply ILR on 10 Years route, Home Office will not check their employment and tax record but this is 110% confirmed that Home Office will check the employment record of last 5 years and Tax record from HMRC if you are currently on Tier 1 General Visa. So please keep your record up to date if its not already updated before to go for your ILR. Thanks & Regards

Please dont provide false information. HO will check tax records all the time irrespective of the visa in doubt.
This is 110% confirmed that Home Office is checking Employment and HMRC record and also matching this with the record they have from your previous Tier 1 General Applications. i have applied for ILR on 10 years rule, i am currently refused my visa because of deception as my income is not consistent with HO and HMRC records. i need urgent advice on this. i want to know if some one has already experienced this and would like to share experience..... plzzzzz help

Can you please explain your case further?
Were you self employed? Which income does not match with HMRC/HO? What was declared in your initial application application and also when you applied during further leave to remain ?

hi there.
I am new to this forum.I am planing to apply ilr on long residence in November. I am on tier 1 general from 2011.I am part time working as employee and self employed as well. I was reading the post about the tax issues AND got some queries.
1. home office check the all 5 years tax with HMRC.
2. The 1 year when I applied for tier 1 and 2 time when I applied extension.
3. do I need to show all 5 conservative years same earning.
I need to amend my tax returns as well .how long will it take to revise my tax return and also if i need to pay a large amount of tax then will I be able to pay them instalments.

There are no of cases reported which have had Tax issues, but at the same time there are cases in which VISA has been granted although the applicant had shady tax record. Its still not clear why some cases are triggered the eyes of the case worker.

I am really very worried as I spoke to diffrents people about my problem and everyone is giving diffrents information.
I wanted to go on 10 years long residence but tax needs to be revised and the only problem is that I won't be able to pay lump sum. Can I ask Hmrc to make an instalment plan. What happened if the tax amount is 32k.
Please senior members help me

Hi Bri2015,
Sorry to hear your refusal. I think you got one option left. You should amend your previous tax return in writing to the HMRC asap and have a copy of that send to HO along with the accountant's letter explaining why the discrepancy happened.
Its highly advisable if you could send all 5 years SA302 and P60 also a professional cover letter(explaining your previous case) by a lawyer with your new application will be beneficial too.
It will take sometime at HMRC end to get your tax details updated but may be you can do your application by post so that u can buy sometime.

refused 322(5) , waiting for admin review , i was advised for fresh application , and my visa has been expired , not sure can i apply after admin review or not?
