help on document visa

Post by Ash1001 » Mon May 26, 2008 1:05 am

Guys need some help...

I am on HSMP visa ....my wife on Fresh Talent...our son was born here in the UK.

Am applying for Tier 1 visa extension and adding Wife and Son as dependents...

Have noticed that on the application it says when did dependent arrive in the uk ....from which country did the dependent get visa clearance before travelling to the UK .........does not apply to my son as he was born here. Dont know what to fill in and cant leave the form blank as will be rejected.

Any advice???

Best is to call HO (01142074074) and ask them.

In the form select option for "EC not obtained before entering UK." and in relevant section fill "Born in --CITY---- U.K" and also clarify in your covering letter.
I have done the same. This was told to me by HO.

My employer had just officially had its name changed, this means their email address changes also. Is it advisable to inform UKBA using "change in circumstances" form about this?
And I actually send the duplicate of my bank statement to UKBA (official duplicate, so it is stamped by local Barclays bank but doesn't have any bank logo) because my mortgage lender, First Direct whom had the original copy, had took exceptionally long in processing the application due to huge backlog. I did mention on the cover letter the reason why I have to send the duplicate instead. Now, should I inform home office that now I had my originals back?

I think it will be better to call HO and cross check with them. Probably they will ask you not to send any additional documents.

I think almost all companies will continue old email addresses for good 6 months before they discontinue old name. Just check with your company if old email address is still active.

I will suggest best is to have a word with HO before doing anything.

p-60 as earning evidence

Post by bajaj06 » Tue May 27, 2008 12:24 am

hi guys,
i need your expert opinion...i am applying for tier-1 visa....to claim points on basis of earning i understand that we consider our gross salary...however, if i want to attach my p-60 as evidence, i was wondering if that can create confusion because amount shown on p-60 is taxable salary and not gross salary....taxable salary is offcourse is less than gross salary.....i am sending my pay slips as well which shows gross salary but p-60 only shows taxable salary.....do you think this might create confusion.
although they accept p-60 as one of proof of earning but how would they calculate gross salary from it or would they take the amount on p-60 as amount for claimimg points.

please help...

Re: p-60 as earning evidence

I think they consider gross taxable salary only. Anything which is not taxable doesnt counts.

although they accept p-60 as one of proof of earning but how would they calculate gross salary from it or would they take the amount on p-60 as amount for claimimg points.

please help...

I think almost all companies will continue old email addresses for good 6 months before they discontinue old name. Just check with your company if old email address is still active.

I will suggest best is to have a word with HO before doing anything.
Thanks anilhemnani,
I've called UKBA and they ask me to fax those changes.
So probably I won't need to send Changes of Circumstances Form 8)

processing time

Post by sswt » Tue May 27, 2008 12:15 pm

Hello guys,

Just thought of updating everybody. When I heard, processing time has been set to 10 weeks, I called up HO today. They told me, the processing time is still on average 6 weeks. I asked if there is any way to put a request to consider my application in a urgent basis as I am switching my job and joining date is in a week time. But fortunately ,according to CC , my application is already with case worker and I might hear within a week time.

But, there is a way that we can put a request to consider the application in an urgent basis. If you put a request for urgency with a valid reason, then they will assign the application to a case worker earlier than the normal time.

My app details:

WP to Tier1
========
App sent : 24/04/08
App Received and ref num generated: 25/04/08
current status: with case worker as of 27/05/08
verdict : TBD

Zella29,

I am pasting a post which I found in other forum.Hope, it will help you if you are switching your job but pls confirm from HO before you send any fax.

====================================

got my stamped passport back today. The letter they sent to me was
dated 1st of April, 2008 when they confirmed they had recieved my
passport and were processing my application.

One thing which I did find and might prove helpful to someone out
there is, if you are in the process of changing jobs (which is why I
applied for my HSMP because I couldn't work for a different employer
on my work permit) you can actually request the people looking into your
application to speed up the process. As I am about to change jobs and was
waiting on my passport, when I called to inquire about whether a decision
had been made or not, I was told to fax them on: 01142076555 a copy of my
job offer and a letter requesting them to look into the matter quicker
as me taking up my new job depended upon having a valid visa.

I guess now that I have got the passport, won't have to fax them,
but if someone has the same situation as me then do try this, you
might just get your stamped passport back quicker and an opportunity
might not go to waste. Good luck!

Hi all,

I have just called the CC myself and was told that the standard service time has now been set to 10weeks on average, although it might not take that long in some cases. No urgent treatment for tier1 as she told me. she also mentioned she is not able to comment on any individual cases (if it's lesser than 10 wks) other than telling us what is the standard processing time. she did mention also that some people got reply less than 10wks. i guess lucky ones like andynaggers etc.

good luck all

oh dear...anxiously waiting..

Thanks sswt,

I am in same situation. I am suppose to join to a company on 1st of next month and I have sent application on 12 th of April.

When I called them up they said it is with case worker and even if you send fax they will not be able to fasten process as it is already with a case worker.

So only solution is just to wait ...

Can we get passports back before decision is made

Post by kmore97 » Tue May 27, 2008 3:00 pm

My application date is 1st May. I have a scheduled plan to travel to India in the first week of July for very very urgent work.

I'll surely feel panicked, if I don't get my passport back by end of 3rd week of Jun.

What do you suggest, guys

1. I wait till end of 3rd week of June and request HO to return my passport for 2 weeks, even though the decision is not made
2. I request HO now itselt to treat my case on urgent basis.

My urgency is not in terms of commercial or business terms, but it's a personal urgency. Will they treat the personal urgency as urgency?

Even, I read it in BIA website earlier, there is no urgent treatment for tier 1 applications.

In that case, CC would have straight away refused of any urgent treatment for tier-1.CC told me " I would advise not to put any request for urgent treatment as your application is already with case worker".

Urgent Query !!

Post by rawpan » Tue May 27, 2008 7:32 pm

Hi Friends,

I would be applying for a Visa to UK under Tier 1 (General) of the Points Based System/PBS. In this regard, I have following query :-

I would like to claim points for my earnings in last 12 months.
As per PBS guidelines, I can claim 12 months earnings in last 15 months period. I would be claiming points for earnings of the period 01 Apr, 2007 - 31 Mar, 2008. I have 2 employments in this period.
Apr, 2007 - Nov, 2007 and Nov, 2007 - Till date.
I am not able to provide all 12 salary slips as I don't have salary slips from previous employer i.e Apr 2007 - Nov 2007.
Can I submit the following combination of documents for claiming the points earnings points ?
1.) Salary deposits by both employers in my bank accounts.
2.) Form 16 for Tax filing issued by both employers for respective periods of employment. Please note that my period of earnings exactly matches the Fiscal period for Tax filing (Form 16) 01 Apr, 2007 - 31 Mar, 2008 & thats what PBS guideline states if you want to use Tax documents for earnings proof.

As per the list of PBS guidelines, the two proof of earnings must be from two separate sources which looks fine with regard to above combination.

Still I would like to clarify. Please let me know if the combination of these two documents can be submitted as proof of earnings. I am specifically asking this as I don't have the salary slips from previous employer.

If anyone knows answer to this situation, please let me know.
Thanks a lot for your kind co-operation.

Cheers,
rawpan

onsite-offshore model--uplift ratio

Post by justin22 » Tue May 27, 2008 7:41 pm

Hi,

I work for an indian tech company and currently I am in the UK on an onsite assingnment.
I get a UK allowance approx 2000 GBP pm and indian basic salary 15,000 INR.
Just wanted to know since the basic salary is earned in india and in indian rupees, will the uplift ratio of 5.5 be applicable inspite of me being in Uk presently?

Logically it makes sense but not sure how the caseworker thinks..

Honest advise appreciated.

Cheers,
Justin
