i'm a little confused. my agency told me that i have the right to work under section 3c but i have read online that it doesn't apply to residence cards. can someone confirm this? thanks
The agency is wrong. Section 3C does not apply to EEA applications.

Hi Tati

I'm not that happy since my COA says no work, as expected though. Still have no idea why my COA arrived before I did my biometrics!

Ah,really? Sorry about that.
There's a chance you'll get your RC quicker than people who apply by themselves.

Hi Tati
Just saw the guidelines, says COA comes after successfully submitting biometrics. Wonder if it was an error. Anyway, I have a feeling it is still going to be a few more months till I hear anything about my application.

Judging from my reading in this forum. Most cases when applicant is partner, but unmarried, COA letter come with no right to work. Under such cases often biometrics letter and COA letter together.
I don't think it's a rule, but it seems a convention.

I also requested online to return my husband's passport back and mine on 02.09. Does anyone know how to contact Home Office to ask if they have received my request?
I knew many ppl had to request again after 10 working days because of no news and HO said they did not receive any info. I do want to be in this situation.

Thanks a lot

Finally I got respond from Croydon about timelines.

She mentioned that they are experiencing lack of staff therefore appkication timelines can be more than 6 months temporarily.

Hi guys,
could anyone please tell me whether it matters.
We'd like to request my husband's passport only(he is EU national).
There are 2 options on HO website - either I request his passport as a main applicant or he does as EEA sponsor.
Does it really matter who requests - myself or I am on behalf of my husband as my EEA sponsor?
Thanks.

I applied for residence card along with my wife (Polish National) in the month of March, 2015 and its been 5 months and we are still waiting for a decision.

I applied initially using EEA (EFM) form as we were only engaged at the time of application but attached notice of marriage, issued by Marriage registrar, with the application. Later, in the month of May, we submitted original of marriage certificate to be attached to the application.

I have tried to contact UK visa and Immigration many times but they keep saying Visa processing takes sometimes 6 months and they would not be able tell anything about our application before the end of 6 months i.e untill the end of September.

Following is the timeline of the application:

23rd March 2015 - Residence Card + Residence Certificate application sent using form EEA(EFM) and EEA (QP)
25th March - Application fees deducted from my account
30th March - Issued with Certificate of Application with right to work.
7th May- Submitted original Marriage Certificate to be attached to the application along with a covering letter.
RC- Still pending

Its been very frustrating waiting so long for the card. I am suppose to travel out of UK in the month of October and thinking whether I would be able to get my Residence card before that.

Please add my details to the March thread. Thanks.

Hi,

After the longest wait and testing every drop of patience, I finally got my Residence Card today. The RC was approved on 27-08-2015 but received via Royal Mail First Class Tracked post today i.e 04-09-2015. My wife also received the Residence Certificate in the same mail and all the supporting documents came in order. So happy for that.

This forum helped me a lot to understand the UKVI process. Wish everyone all the best with their respective applications. Stay positive.
