Stupid mistake again in queue---HSMP Extension

Post by viren68 » Fri Sep 15, 2006 8:32 am

Hello All,

My friend applied for HSMP ext on 7th August 06. His initial HSMP visa is expiring on 22/09/2006.

There was a new FLR(IED) form out on 22/june/2006. Instead he filled the previous old form. Paid extension fees via Postal order (£250 + £85) everything was OK. Even I also checked that the form and everything in the file was in order, but failed to notice the vaildity of the form.

Finally after three weeks his passport was returned. We were very much depressed and spent two days in pub.

Again made the postal orders and applied on 5th spetember. Visa is expiring on 22 september and we are worried by that time the passport might not come back.

The number 0114 207 6016 is very busy and not able to talk to HO

What to do please.

Viru, as the application has gone in prior to the expiry of the old visa then he can stop worrying!

The reason is simple ... legislation commonly known as "Section 3C". It works like this. As long as the application for the new visa is submitted prior to the expiry date of the old visa, that old visa is "treated as continuing" until they get round to dealing with the application that has been submitted, and if for any reason the application is rejected, until the time for appealing against that rejection has passed.

So if he does not hear the result of the application prior to 22nd September ... no worry ... he still has a valid visa ... he will not suddenly become an overstayer on the 23rd.

Hello,

Thanks John & arm very much for the quick reply.

She is not working in her HSMP designated field but the earnings are good. Showed a bank balance of about £6500/= , salary slips, etc.

Are you sure the caseworker will give four years extension?/

thanks

From antecedents as revealed by previous posts on the issue, she should be able to get an extension as she is ECONOMICALLY ACTIVE.

Hello John, Alex and others,

Today 20/9 has passed and no info of any kind. I have faxed the urgent treatment form as well. As She has to report to another employer for the job. I dont know what will happen and very much confused.

Is there any other number besides 0114 208 6016, Where I can talk to the officer.

do not worry... even if you receive it late, the new visa would be stamped and it would be valid from 23/09/2006 onwards...

Vir, I fear you are not fully taking on board my post in this topic on 15th September. So you still seem to think there is some sort of panic over this matter, whereas there is not.
