I had an affair with a British man who is married to an Algerian lady. I didnt know they were married at the time. The Algerian lady entered and worked in th UK illegally initially then married her British husband 2 years ago. of that 2 years 1 year was him having a relationship with me, although they did live together as a married couple.

She is now applying for indefinate leave to remain as their two year anniversary is coming up. I know I'm a bit biased but she is a really nasy piece of work. Would her application to remain be successfull if immigration knew about a)her initial illegal staus (or would she have had to declare this to get married) and b) the year that he had an affair?

I dont plan on acting on any of this its more a curiosity thing as I have very little knowledge of the immigration system.

it is if she is breaking the rules and will stay when she shouldnt. I have no idea if their relationship is a sham or if they are giving it a proper go. I was just curious as to what could happen. Its not fair on genuine applicants and proper marriages if it isnt real if she got to stay.

he's the one who had the affair! As you say you have no idea whether the relationship is a sham, therefore you are not in a position to say whether she is breaking the rules are you?

No one can possibly say what will happen on the basis of information given by someone who is clearly unaware of tha actual facts of the case.

Firstly you had an affair with her husband for 1 year knowingly that he's married man and secondly you are trying to report her for entering illegally this country, the UKBA agency have granted her permission to marry her husband they were obviously aware regarding her previous status otherwise she would have been removed and since she's got married and have been together with her partner for 2 years that proves a geniune relationship rather than sham marriage as you claim.she can divorce her husband on the grounds of committing adultery if she finds out about his infidelity and cheating hence she can remain in the UK on that basis. I am sorry I have been member in this forum for few years now and never come across someone with an EVIL mind such as your self who strives to harm and cause fiasco in people's life!!!! surely there must be plenty of mens out there that you can have a life with??

jennie_b, in your opening post you used the word "had", so it sounds like the affair has ended. That being the case you will not be worried that in order for the wife to get her ILR the husband needs to sign a declaration including :-
I confirm that I am the spouse or civil partner of the applicant. I declare that we are still married and that we are living together as husband and wife and intend to do so permanently
