ILR eligibilty

Hi,

I got my initial TIER 1 visa on 11 January 2009, but entered UK on 16 April 2009. That means entered UK after 3 months 5 days.

I applied for visa extension in 09 January 2012.

Now my visa got extended and valid till 15 March 2014.

Now am I eligible to apply for ILR if I apply in March 2014?

Please give your suggestion.

Under current rules, no.

Come back with the question in Jan 2014 ... and it will be possible to answer the query accurately based on the rules / policy in force at that time.

But as per the new rules, 3 months late entry to UK is acceptable. which means if you complete 4 years 9 months stay in UK, you are eligible to apply for ILR.

But in my case, by the time 15 March 2014 I will be completing 4 years 11 months. so I am eligible... Am I correct? Please correct me if I am wrong.

There is a difference between "3 months and 5 days" and "not longer than 3 months".
