SET O - Few Important Queries - Please clarify

SET O - Few Important Queries - Please clarify

Hello all,

I have below queries on newest SET O (valid from 6 April 2012).

My Story so far:
  • Initial Entry clearance HSMP Visa granted on: 31-AUG-2007
    ENTERED UK FOR FIRST TIME ON: 24-OCT-2007
    EXTENDED AND SWITCHED TO TIER-1 GENERAL VISA: APRIL 2009
    CURRENT TIER-1 GENERAL VISA will Expire on: 31-AUG-2012
    Total Absences from UK: 4 weeks (1 week in March 2008 + 1 week in Jun 2008 + 2 weeks in December 2008)
(1) When I first entered UK in 2007, my age at that time was 29.

But on Page # 23 in SET O, I have no option to choose points for my age as it is more than 31 years now (since my age in 2007 was 29 and now it is 34!!)

Will I not be able to claim points for my age?

(2) on Page # 23, refer to question D1. It asks "Please confirm whether you have spent a continuous period of 5 years lawfully in the United Kingdom".

Should I TICK or leave it? As I will not be completing FULL 5 YEARS yet!! as I will be applying 28 before my Tier 1 General VISA expiry date.

Please could someone help clarify above two queries?

1) You will claim the SAME points, as it clearly says (you age the the time of your INITIAL (HSMP) Grant

2) You have to tick the box
