UK spouse dependent visa to ILR query - new rules from July9

Dear Experts/Seniors,

This query is behalf of my cousin. Would appreciate your advise

He is a turkish national married to UK citizen 3 years ago. He got stamped his Uk spouse Dependent visa on 29th July 2010 from Istanbul. He landed in UK on 20th August 2010. His Dependent visa is valid until 29th October 2012.

My queries:

1- Can he apply for ILR before 9 July rules come in to effect? ( given he landed in uk on 20th August 2010 his 2 yr period is finishing on 20th august 2012, so can he apply fir ILR 28 days before 20th August 2012)

2- In case he cannot apply for his ILR before 9 July 2012, will he come under 5 year route for settlement. so what visa should he apply if he applies after 9 july 2012

3- If he applies before 9 july, ( say by 6th July by post ) will he fall under new rules or old rules? ( he cannot get any PEO appointments as of now )
