Tier1 dependant extension OR wait for MN1 for the child

Hello,

I got Tier1 dependant visa for my child born in the UK (as we needed to travel), which is valid till Feb 2013.

I will be applying for my 2nd Tier1 extension in Feb 2013 and will be eligible for ILR in September 2013. I understand that I can apply for MN1 registration for my child only after my ILR.

Do I need to apply for my child visa extension (Tier1 dependant visa) in Feb 2013 or wait till Sep 2013 for MN1 registration? Also, what will be the child’s immigration status From Feb 2013 till Sep 2013 if we wait for MN1 (child currently holds Tier1 dependant visa valid till Feb 2013)?

Please Note – I do not intend to travel from Feb 2013 till Sep 2013.

Thanks sushdmehta. It seems Mr Riay had same query and it would have been useful to have answers to our queries contained in official UKBA document(s) to be on safe side. But many thanks for your response.

To be honest, both you and riay are expecting the unexpected.

Why? Because there are two different legislations in play - for immigration, it is the Immigration and Asylum Act, and for citizenship, it is the British Nationality Act - and the two are mutually exclusive.

I don't think you would find any official guide which states one doesn't need to apply for something...
