tier1 appeal

Hello guys

My tier1 extension was refused i went for an appeal now after the appeal hearing if the appeal does not go in my favour & that i had to go for a fresh application

1) can i not get a premium same day service.
2) my tier 1 visa expired on 15 th may 2012 my appeal hearing is on August 5th 2012. if i file fresh application after appeal hearing depending on the outcome can i not show my earning for the month of May,June ,July

let me know your feedback ASAP.
