28 days rule for ILR

Guys I have a question to ask;

If someone is finishing his 10 years in 28th September
But he got a visa till 1st September,
Can he applied ILR on the bases of 10 years long residence
at 1st September 28 days in advance?????

yes but he should apply for an extension of the current visa

So without extension its not possible?
As the applicant will be applying by post he/she may not need to apply for an extension. This is because he/she may satisfy the 10 year residency requirement by the time the UKBA CW actually considers the application (i.e. if they only get to the application after Sept 28th because of the volume of ILR cases they have). Do find out what the current processing times are first, by going over the sticky for the 10year ILR route available on this forum.

Well, that’s amazing if it can work like that, I was actually in the impression that a person can’t apply long residence even a single day in advance without strictly completing 10 years.

I would love to know someone who has applied ILR 28 days in advance with visa finishing before 10th anniversary.
