Married whilst on a visit visa

Post by monamd » Tue Jul 24, 2012 4:39 pm

I am here on a visit visa as a canadian national and married at the registry office to my partner of 7 years, she is a British citizen.

I meet all the requirements for the new spouse rules but will they refuse my spouse entry clearance application because i married whilst on a visit visa? has anyone had success doing this?

They shouldn't - but remember you need to return back to Canada to apply.

In theory - if you came to the UK with the intention of getting married - you broke the rules.

But it'd be hard to argue - and plenty of people do get married on a visitor visa.

Hey ....

How about if I got married while on PSW? ... I've been here 5 years now, first 4 on student visa, now on PSW ...

Do I need to go back to home country to apply? which will be hard because my company won't give me the numerous months holiday that it takes to get a decision OR can I use FLR(M) ?

Oh one more question, when you say you got married, is that the registry thing or a proper wedding with all the relatives and all of that? Does it have to be both?

Thank you very much in advance ....

you can get married on PSW with no problem , and you can switch PSW from UK to spouse visa as this kind of visa is residency one, but you should have at least not less than 6 month left on your current visa PSW.

You should have valid limited leave. There may be less than six months remaining, provided you had been admitted for more than six months (284(i)).
