Use of ILR?

Post by vennk0 » Wed Jul 25, 2012 5:03 pm

Hi,

I came to UK in Oct-2008 and I will be completing 5 years by Oct-2013.

I was out of UK on vacation

1. From 05-Mar-2010 to 21-Mar-2010 (17 days)
2. From 12-Nov-2011 to 04-Feb-2012 (84 days)
3. From 20-Mar-2012 to 24-Apr-2012 (34 days - this is due to my fathers demise)

Am I eligible for ILR in Oct-2013 considering above duration being out of UK?

Also, can you please advise what is ILR? - Does it mean that after I get ILR, I can come to UK at any time of my life (even thought I do not stay in UK after getting ILR) or are there any conditions around it (like I need to stay in UK for minimum of one year after ILR). Sorry for this question, but I could not find correct answer in any blog I went thru.

Thank you.

Absolutely no mention of your current immigration status! How can you expect anyone to offer you comments and suggestions?

Your eligible for ILR considering case as below. None of your breaks are more than 90days and are apid and total less than 180 so no issue I believe.

Sorry, I came to UK on Work Permit and shifted to Tier-1 (General) in July-2010. Currently on same category.

Please advise

I'd suggest you read the FAQ & information posted under the following sticky to begin as it will help you answer these questions yourself & give you more useful information.
http://www.immigrationboards.com/viewtopic.php?t=79378

Specifically, see Q3, Q4, Q16 for the questions you have raised.

ILR means "Indefinitive Leave to Remain". Once you gain it you will be free from immigration control in the UK. However if you reside outside the UK for more than 2 years after this, it will result in you losing your ILR status.

If you wish to, you may apply for British Citizenship one year after you have gained ILR. See following sticky for more information.
