Tier 5 Charity or Creative?

My company is a not for profit organisation specialising in the creative sector and wish to hire a dancer, artist and musician.

I understand i must show that i am a regulated charity, which we are nut my question is:

Can i employ a migrant and apply under the tier 5 sponsor license and assign a Certificate for the creative category? the migrants will be paid.
