Hello there,

I initially came in to the UK in August 2007 on WP and got Tier1 in May 2009. Spouse joined me in June 2011 with Tier1 Dependent.

I further got Tier1 extension in May 2012 for me and dependent tier 1 for spouse.

Since I was completing 5 years in August 2012, I applied for ILR on 24th July 2012 (28 days before) with success.

So, spouse is currently on tier1 dependent valid till May 2014 and I am on ILR w.e.f July 2012.

As per FAQ for ILR ( http://immigrationboards.com/viewtopic.php?t=79378 ) Q13 and response, I do not have to apply for FLR(m) for spouse as her current (PBS dependent) leave (May 2014) will expire after she completes the qualifying period - which is June 2013.

Can some body from senior members confirm that above understanding is correct and guide me to this information on UKBA site please.

If not, how long does she have to switch to FLR(m).

Quite a few people in the same boat thanks to the mixed messages from recent policy changes. I've got the same question.

there has been a recent case where a person was refunded money as his dependent (the wife) didn't needed to apply for FLR until her visa runs out.

but according to the rules i have read you have to apply for flr as your (main app) visa status changes so it becomes necessary to do so

innocentdevil, the 2 points you have said contradict each other and you have confused me more now.

can you direct me to information/rules where it says that a new visa has to be applied for?

I am in exactly the same situation, I have extended my Tier 1 G visa in April and I and my wife has Visa till April 2014, Since I am now qualified for ILR, I will be applying for ILR this tuesday and I am still undecided as to what to do with my wife visa application ( I have taken PEO appointment a week down the line)

If somebody can direct to some concrete information in this regards than can be very helpful and save me lot of money as well

Can some senior members please help with this query? Is an FLR(M) application for a dependant after grant of ILR, even if the Tier 1 dependant visa is valid long enough to qualify for ILR?

i have said what I said as per the UKBA guidelines and that is one should get FLR(M) approved after his/her visa status changes.

but like i said before there has been a recent case where a person got his fee returned and told to not worry about it.

best to ring ukba and find out.
