Hello everyone i m due to apply for ilr on 10 year residence category. i m currently here on tier 1 general visa and have my wife as my depedant. my wife and my uk born son are in my home country india for past 7 months...my wife has tier 1 dependant visa which is valid till may 2013, but for my son v did not apply dependant visa only got his indian passport issued from london as they both had to travel to india urgently..now my question is can v apply a dependant visa for my son from india while my application for long residence is still under process at the home office? and also can my wife and my son travel to join me in the uk on their tier 1 dependant visa while my application for long residence is under process with the homeoffice? thanks v much

It would be helpful if you could provide expiry dates of your and your wife's respective visas.

Have you looked at if you qualify under 5 yr route?

Yeah not until 2015. I qualify under 10 year route earlier hence applying now. Thanks

Currently, 10yr route is taking approx 6 months to process. And you will be without your passport during this period. And you can apply for this route anytime after you have completed your 10 yrs.

For reasons of practicality, could your son apply for T1G Dependent visa from India before you apply for your ILR?

From my understanding, you continue to be a T1G until your ILR is approved. And by default, your wife and son's T1G Dependent visa would continue to be valid until its expiry or your own ILR approval, whichever comes first.

Let's see what experts' views/recommendations are.
