Hi,

Apologies in advance, I know this question probably has been asked before, however, I would appreciate if someone could clarify this.

I recently got my ILR in Aug this year.
I have two dependants wife (who came to the UK before Jul 2012) and a UK born child. Their current leave valid till Jul 2014.
I did not apply for my wife's ILR at the same time when I made my application as her 2 years were not complete yet.

I referred to the Q12 and Q13 of the faq's here http://www.immigrationboards.com/viewtopic.php?t=79378
and I understand that I do not need to apply for my wife's FLR(M) and she would be eligible to apply for an ILR directly. Is this correct ?

Also, We are now planning to visit family abroad, and I was wondering if it's OK for my wife and child to travel outside the UK , given the fact that I have switched to ILR and they are on PBS dependent visa valid till 2014.

Please please, can some one clarify this. I have been reading various posts on this forum but am still confused .

On what basis did you apply for ilr?
What was your immigration status before applying for ilr?[/list]

I was on work permit from 2007-2010 then applied for Tier1(G) along with my dependants in Jul 2010 (was given 2 years till Jul-2012, which was just short of a month for my ILR qualifying period).
Therefore, applied for Tier1(G) ext. for myself and dependants and got it till Jul 2014.
In Aug 2012 applied for my ILR. Have now got my ILR where as dependants are on Tier1(G) dependant visa.

Assuming you applied for settlement under economic route (PBS):

Since PBS dependants can now extend their leave (as PBS dependant) even when the principal PBS migrant has settled status or has acquired British citizenship, travelling outside the UK (and returning) will not be an issue.
