ILR to TIRE 1 - Variation of Leave - Fees Query

Post by johngt » Wed Sep 26, 2012 3:56 pm

I applied for ILR in July 2012 VIA PEO, however my application was not dealt with on the same day as further enquiries had to be made, and further receive a letter requesting for some documents. Since my visa was expiring on 23rd July and I was not in a position to to submit the requested document within the 14 days given, hence I choose to Vary my Application to Tire 1 general.

I now have received my Tire 1 general extension.

With regards to the fees I have been charged:
1, 1377 for ILR PEO
2, 1500 for Tire 1 extension

I believe I am eligible for a refund of 1377 pounds, as I choose to vary my leave before a decision has been taken on my ILR application…

Please can someone guide me on how should I be proceeding to get this refund?

Any guidance/pointers in this matter will be appreciated.

See section 4 in Set (O) Guidance and that should answer your question.

Assuming that your request to vary your application was received before a decision on your (ILR) application was taken, then you are entitled to a refund.
You should have only paid the difference in fees when making a request to vary.

You'll need to contact UKBA to figure out where and how to claim the refund.
Life isn't fair, but you can be!
