Do I need to justify absence from UK for single trip of 85 D

Post by Vrajdham » Sat Sep 29, 2012 10:17 pm

Please advise me – My absence from UK in single trip is 85 days(working from offshore).
Find below details

Date of UK Entry Clearance – 29th Jan 2007

Date 1st arrived in UK – 17th March 2007

Date of ILR application – 10th Oct 2012 (just in next 10 days)

Total days out of UK – 150 Days

Max days out of UK in single trip – 85 Days (I was working from off shore and got Indian Salary)
Note: When I came back and worked for same client and same IT Company on same Visa.

I am applying as Tier 1 (General) Migrant for ILR Visa.

Do I need to show employer letter explaining reason of working from off shore? If yes, now I am not working with same company so is there any other alternative?

Appreciate prompt reply as my ILR appointment is on 10th Oct.

hanks in Advance,

Please advice, will they consider working from offshore for 85 days as break in continuous residency?

My appointment for ILR is on 10th Oct.

Thanks in advance

If the total number of days outside the UK during your residency period was only 150, i.e. less than the allowed threshold of 180 & no single absence was greater than 90 days then there is no requirement to justify these.

Thanks for cs95tdg your reply. Much appreciate. in Section 6.2 of SET(O) form they have asked "reason for absence". If I write worked from India for those 85 days, will it create any problem in my ILR Visa processing? if yes, any suggestion what reason I can mention?

You could be creative in answering that question and say 'overseas assignment - India'.

IMO, 'offshore' is a tricky word to use as this may be interpreted adversely to your situation.

At the same time, since you are not in breach of 90/180 days rule, this should not be a problem, but do not bring up the 'indian salary' issue if not asked.

Good luck

Did caseworker ask about the absence?
Mine is a similar case, but working from home in India, salary paid in UK, went for personal reason.
No of days absence is 58 days...split up in two trips last year. Total absence in 5 years is 142 days.
Where did you applied?
