Can i convert to T2G and apply for ILR after 5 years

Post by szb » Thu Oct 04, 2012 3:29 pm

Posting the Query on behalf of my friend

Hello Experts,

background:
i got my Tier 2(ICT - Established staff) made in June 2010 and i have entered UK in July 2010 and continue my work with the same employer so far and my visa extended last month(August - 2012) which converted to Tier 2 (ICT - Long Term).

Query?
1. Am i eligible to switch to Tier2 general
2. After switching to T2G, is my continous stay of 2 yrs will be added to T2G
3. Finally am i eligible for ILR after completing 5 yrs
4. If point 3 is No then what is the other option to get ILR please?

Thanks in advance

1. Am i eligible to switch to Tier2 general - Yes, if you change employer
2. After switching to T2G, is my continous stay of 2 yrs will be added to T2G - Dont think so, please double check with an expert
3. Finally am i eligible for ILR after completing 5 yrs - NO. (However, you can indefinitely apply for extensions. You missed the ILR bus by 2 months my friend)
4. If point 3 is No then what is the other option to get ILR please? See point 1

35k rule applies from 2016 and I don't believe it has to be 35k all along, I guess last yr or a confirmation on the date of ILR

any comments?

The OP hasn't switched to T2G yet.

Those who enter Tier 2 under the rules in force from 6 April 2011 will need to meet the minmum pay threshold of £35k (after April 2018 this may be increased) or the going rate for their occupation, whichever the higher. The only exemptions are PhD and shortage occupations.

Agreed we never said but I was just clarifying that the 35k rule applies at the time of ILR application not throughout the 5yr period.
