Eligibility dates for SS route

Post by greatscott » Mon Oct 22, 2012 6:12 pm

Question 1: for SS route: the date one arrives to take up residence is the date from which the 5 years to PR is calculated, even if the RC is issued 6 months later?

Q. 2: (via the SS route) the date from which a non-eu spouse is entitled to stay on in the UK in his/her own right (should the British spouse pass away (before PR is reached) is this 1 year from the date of entry? or is that from the date the RC is issued?

I know for most EU countries e.g. Holland- the countdown is taken from date of entry into the country where it is clear that entry has been for the purpose of settling.

I should point out that SS in this case stands for Surinder Singh.

I have put together a (I think) complete discussion about when residence begins. This applies to all entries under EU law, including Surinder Singh.

I also have question on this topic I came to UK on student visa and back then to be able to marry here you needed to have COA once you get it then you were allowed to marry here and it was time taking procedure. Like applied jan/2007 and received april/2007 and married jun/2007

So when does clock start ticking COA application or marriage date

The (marriage related) COA is simply the date from which Her Majesty has allowed you to marry should you wish to.
