Tier 4 to Spouse/Course to Study

Post by Touchstone57 » Wed Oct 24, 2012 9:29 pm

Just wondered if people can give me some advice. My wife has currently been studying here for a year to get her masters and her (tier 4) will expire in January.

Now, we wish to apply for a Spouse visa, but I have only been working in my current job for two months, so I don't meet the required salary, even though I have a contract stating £19,000 earnings.

We won't be eligible to apply until Febuary at least, which doesn't count the application times.

Naturally we don't to be separated for several months in different countries. Is there anything we can do/what can we apply?

We thought that she can apply for another course to extend her student visa by taking another course giving us the time to apply for spouse visa. Will that make her eligible to apply if her original visa is extend?

Can anyone recommend a course that she could take? Is there a cheap/part time course that can be taken, as we don't have much money.

It may be a lot to ask but we are desperate not to be separated.

She can take any course that represents progress from her previous situation.

61.If a Tier 4 (General) student has a CAS and previously had permission to stay as a Student or a Tier 4 (General) Student then a Tier 4 Sponsor can give them a CAS for a new course, only if that new course represents academic progress from the previous study.
An example of academic progress would be where a student will be studying for a new qualification at a higher academic level – for instance moving from a course at NQF 6 to one at NQF 7, or study at the same academic level that complements or enhances previous study at the same level.
