Applying for Tier 2 (General) visa with a restricted CoS

Hello Everyone,

Could you please help me out with one question?

I'm on a Tier 4 visa at the moment and I'm seeking to switch to Tier 2 (General) visa. My employer is currently carrying out a resident labour market test. After that is done they're going to issue a restricted certificate of sponsorship to me. However, they haven't mentioned that in order to apply for the UK visa I will have to go back to my native country. Therefore, I was wondering whether in every case a person receives a restricted certificate of sponsorship they must apply from outside the UK?

if you satisfy the conditions for switching from T4 to T2G set out in paras 17-19 of the T2 policy guidance then your sponsor should assign an unrestricted CoS to you.

Restricted CoSs are for applying for entry clearance from abroad.

Just one more thing I wanted to ask. As far as I understand an employer does not have to carry out a resident labour market test in order to issue an unrestricted CoS, right?

RLMT has to be carried out by the sponsor for both restricted and unrestricted T2G CoSs (but there are some exemptions).

I think Tier 4 migrant should not require RLMT, if they meets the switch requirement
