Tier 2 dependent of Settled person, can she travel abroad?

Hi Experts,

Appreciate if you could please advice of my below query.

I have ILR visa and my wife is still on Tier 2 dependent Visa valid until Aug 2013.

I am looking to know if she can travel abroad or do I have to apply for FLR(M) visa first before she can leave UK?

Hi sushdmehta,

I got my ILR based on 5 years continuous employment route, via Tier 2 ICT.

1. She may travel, no problem. 321A(1) will no longer be applicable here because a PBS dependant can now extend leave as PBS dependant even after the principal PBS migrant has applied for / received settled status and British citizenship.
2 Switching to FLR(M) is no longer must, as explained above.
