naturalization application (after 3 years)

hello every one. i hope some one can help me here. i came uk on spouse visa in 10 feb 2010. i got me ilr 9 july 2012. i have never travelled out of uk ever since i came uk. i will complete my 3 years on 11 feb 2013 . my question
(1) is can i apply for naturalization application soon after 11 feb 2013 or i need to complete another one year after got my ilr which will be completed on 10 july 2013.
(2) my husband's british passport is expired.can i submit his expire passport in my naturalization application?

hope some will answer me soon.

You must be free from immigration time restrictions when you apply for naturalisation. In addition to that, you must have had ILR for 1 year if you apply on your own. If you are applying on grounds of marriage with a British citizen, though, the latter does not apply. See here and here.

That is no problem, just submit his last one. You need to prove that you are married to a British citizen. It is no legal requirement for your husband to have an up-to-date passport.

If I read the data right, you:
- have been resident in the UK for 3 years: check
- have been present in the UK on the day 3 years before the application: check
- haven't been absent more than 270 days during the 3 years: check
- haven't been absent more than 90 days during the last year: check
- will be present on the day HO receives your application: check
- are free from immigration restrictions on the day HO receives your application: check
- haven't been in breach of the immigration rules at any stage: check
- meet the English / good character / sound mind requirements: check (I just assume that.... ;) )

Ergo, you are good to go from the 11th February on. Good luck!

A British citizen by descent does not naturalise, so there is no naturalisation certificate.
